Conditions for adopting a child
An orphan is a child who has lost one or both parents, or who has been left without the care of parents or legal guardians. Orphan status can arise for a variety of reasons, including the death of a parent, termination of parental rights, statelessness, parental abandonment of the child, and other circumstances where the child is left without proper care. Special measures of social protection and support are often provided for an orphaned child to ensure their proper development, well-being and integration into society.
Thus, Ukrainian legislation recognizes the adoption of children as a priority form of placement for orphans and children deprived of parental care. Adoption allows a child to find a stable and loving environment in a new family, as well as receive comprehensive support and improve their future.
The legislation provides for a thorough screening of candidates for adoption in order to ensure the best conditions for the child. This review includes an assessment of the financial, psychological and physical condition of the candidates, as well as their readiness and ability to raise and care for a child.
After the successful completion of the adoption procedure, the child acquires all the rights and responsibilities of the biological parents in his new family. It is important that the adoption process is carried out in the interests of the child himself, taking into account his needs and well-being.
Ukraine also cooperates with various international organizations and institutions in the field of adoption to ensure international standards and practices in this field.
In accordance with the cited paragraph 135 of the Procedure for conducting adoption activities and supervising the observance of the rights of adopted children, during the period of martial law and within three months after its termination or cancellation, as well as in the event of a military conflict, the activity of adopting children by citizens of Ukraine who temporarily or permanently reside (stay) outside of Ukraine, and foreigners are suspended.
This restriction is imposed in order to ensure the safety and well-being of children, as well as in connection with the difficult conditions that may arise during a period of martial law or military conflict.
After the end of martial law and a three-month period after its termination or cancellation, adoption activities can be resumed. However, it is important to consider that the restoration of this activity may be associated with certain limitations or procedural features in the context of the restoration of the normal functioning of society after the crisis period.
Child adoption procedure
The procedure for adopting children in Ukraine includes a number of mandatory steps, including submitting an application and necessary documents to the relevant authorities. According to the above text, citizens of Ukraine who wish to adopt a child apply to the children's service at their place of residence and submit a number of documents, which include:
1. Copies of identity documents.
2. A copy of the identification code.
3. A copy of a document with a unique record number in the Unified State Demographic Register, if available.4. Copy of marriage certificate or extract
5. Information on the absence of a criminal record for each applicant.
6. Certificate of income;
7. Conclusion on the state of health of all participants in the case (applicants).
8. A copy of the document confirming the right of ownership of housing or the right to use housing.
9. Consent of the second spouse to the adoption of a child, which is notarized.
