Recently, our team was asked a question: “Доброго дня, в мене на руках є висновок ВЛК про відстрочку від призову та відмітка в військовому квитку (стаття 81 2 пункт), чи можу на основі даних документів виїхати за кордон? Чи можу з даними документами стати на спеціальний військовий облік та виїхати за кордон?”

18.06.2022 14:35:37 Можете, якщо під «відстрочкою» малось на увазі «тимчасово непридатний до військової служби за станом здоров’я на термін до шести місяців», і про це є висновок ВЛК, військово-обліковий документ з відповідною відміткою. Вважаю Вам для цього не потрібно ставати на спец.облік, Ви вже отримали відмітку у в військовому квитку. Для виїзду керуватися п.2-6 Правил перетинання держ.кордону, затв.пост.КМУ від 27.01.1995 №57 https://zakon.rada.gov.ua/laws/show/57-95-%D0%BF#top і останніми актуальними розясненням прикордонної служби від 03.05.22 на сайті https://dpsu.gov.ua/ua/Peretinannya-derzhavnogo-kordonu-v-umovah-pravovogo-rezhimu-vonnogo-stanu/
19.06.2022 10:25:31 Так з посвідченням про відстрочку ви моете виїхати за кордон. Законодавець у ст. 23 Закону України «Про мобілізаційну підготовку та мобілізацію» зазначає категорію осіб, які мають відстрочку від призову на військову службу під час мобілізації. А постанова КМУ від 27.01.1995 № 57 «Про затвердження Правил перетинання державного кордону громадянами України» відповідно дає право перетину кордону цій категорії осіб.
