Recently, our team was asked a question: “Яку на практиці відповідальність несе військовозобов'язаний, якщо він повернувся в Україну пізніше, ніж повернулася його дружина з інвалідністю ІІІ групи? Він супроводжував дружину за кордон.”

25.11.2023 13:50:32 Військовозобов'язаний несе відповідальність за порушення строків повернення до України, якщо він повернувся пізніше, ніж його дружина з інвалідністю ІІІ групи. Згідно з чинним законодавством України, воїни, які перебувають на строковій службі, мають обмежений час для перебування за кордоном без дозволу командира. Якщо вийти за межі цих обмежень без дозволу або повернутися поза встановленими строками, то особа може бути притягнута до дисциплінарної або кримінальної відповідальності. У даному конкретному випадку, якщо воїнова дружина з інвалідністю ІІІ групи повернулася ранiше нього, а сам вiйськовозобов'язаний супроводжував її за кордоном, то бажано отримати письмове дозволу командира на перебування за кордоном протягом певного часу. Якщо такого дозволу не було отримано або встановлені строки були порушені, то військовозобов'язаний може бути притягнутий до дисциплінарної відповідальності. Деталі та конкретні наслідки залежать від законодавства України та регламентуються умовами контракту або законодавчих актів, що стосуються військової служби. 26.11.2023 23:35:04 Громадяни України чоловічої статі віком від 18 до 60 років, зазначені в абзацах третьому - сьомому, дев’ятому і десятому цього пункту, які супроводжували осіб з інвалідністю, дітей з інвалідністю, осіб, які потребують постійного догляду, чи дітей, визначених пунктом 2-2 цих Правил, для виїзду за межі України, зобов’язані повернутися в Україну не пізніше повернення на територію України осіб, яких вони супроводжували.

27.11.2023 06:44:26 Доброго дня! Така відповідальність законодасвтвом не передбачена. Максимально - це можуть не надати дозвіл на повторний перетин кордону. Проте, навіть, це можна оскаржити в судовому порядку.
