Ukrainian drivers will have to change their driver's licenses. The corresponding draft law No. 8082 has been submitted to the Verkhovna Rada for consideration and has already received preliminary approval from the specialized committee. The Cabinet of Ministers of Ukraine initiates changes to the validity period of Ukrainian driver's licenses and the conditions for allowing citizens to drive cars. Reasons for preparing changes
The draft law proposes the introduction of some European Union standards into Ukrainian legislation and is implemented within the framework of the action plan for the implementation of the Association Agreement between Ukraine and the EU. This document aims to harmonize categories of vehicles and establish minimum and maximum ages for driving different categories of vehicles.
The amendments provide for additions to the Law "On Road Traffic", regulation of the validity period of driver's licenses, procedures for suspension, renewal, exchange and recognition of their invalidity. It is also stated that driver's licenses issued before the entry into force of the new law remain valid until their expiration date, but no later than January 19, 2033, and are not subject to mandatory exchange, with the exception of cases specified by law.
New category type in driver's license
The draft law introduces a new AM category for mopeds (two- or three-wheeled) with a maximum speed of up to 45 km/h and an engine volume of up to 50 cm³ (for electric mopeds - a maximum power of up to 4 kW) . Light quadricycles included in this category have a mass of up to 350 kg, a maximum speed of up to 45 km/h and an engine capacity of up to 50 cm³ (for electric quadricycles, the maximum power is no more than 4 kW).
These changes expand and refine existing categories. For example, mopeds and scooters, previously classified as A1, are now classified as AM. Tricycles and ATVs, which were once in category B1, will now be covered by AM. Categories A1, A2, A and B1 will also be specified with regard to the maximum parameters of speed, engine volume and power.
From what age and what rights will be issued
Persons can drive vehicles only if they have the appropriate driver's license of the appropriate category, if their license has not been suspended.
Regarding age restrictions:
- categories AM and A1 are available from the age of 16.
- Categories A2, B1, B, BE, C1, C1E, C, CE are available from the age of 18.
- Category A is available from the age of 20, if there are management skills of category A2 for at least 2 years, or from the age of 24 without such requirements.
- Category A (tricycles) is available from the age of 21.
- Categories D1, D1E, Tm (tram), Tb (trolleybus) are available since 21.
- Categories D and DE are available from the age of 24, or from the age of 21 with a document of professional competence for cargo transportation or professional education.
- Military servicemen, police officers and members of the civil defense service can be granted rights to category C from the age of 18, to category D - from the age of 21.
Driver's licenses issued for categories A1, A2 and A confirm the right to drive category AM. For category A2 - for management of category A1. For categories A, B, C, D confirm the right to manage categories A1, A2, B1, C1, D1.
If the practical test is taken on a vehicle with an automatic transmission, this information is noted on the driver's license. A driver's license with such information gives the right to drive vehicles of categories A1, A2, A, B, BE, B1, C, CE, C1, C1E, D, DE, D1, D1E only with an automatic transmission.
What changes are introduced regarding the terms of validity
Driving licenses will be valid as follows:
- AM, A1, A2, A, B1, B and VE - 10 years.
- С1, С1Е, С, РЕ, D1, D1Е, D, DE, Tb and Tm - 5 years.
For driving licenses in categories AM, A1, A2, A, B1, B, C1, C, issued for the first time, the validity period is limited to two years.
The validity of the certificate is suspended after two years for those issued for the first time, as well as in case of detection of forged documents. Information about the need to submit a certificate is sent by registered mail within 15 working days.
Driver's licenses are considered invalid in the following cases: expiration date, loss or destruction of the license, acquisition of rights by another state, failure to appear for rights issued for the first time, or failure to fulfill the obligation to exchange within 1 year from , when there was a reason for the exchange.
