Obtaining an OGD for a fallen serviceman

It's a pity, but the current circumstances force us to provide legal assistance to the families of fallen servicemen. Unfortunately, receiving payment for a fallen military serviceman is now a frequent question among clients.  If you have difficulties with receiving compensation and there are soldiers killed in the war, you can always turn to us for help. And now we will try to reveal the main thing about the procedure if there are casualties in the war. 

Who has the right to appeal.

 The following have the right to apply to the OGD for the deceased:

1. Parents;
2. One of the spouses who did not remarry;
3. Children who have not reached the age of majority (a clarification has appeared regarding children of full age);
4. Dependents of the deceased (deceased).

 From April 2024, adult children were also included in this list. 

Where to submit an application for OGD:

In order for the process of filing documents to be successful, you need to know where to turn. The application, when compensation for the deceased in the war is provided, is submitted to the following structural units. The application should be submitted to

•   district (city) territorial center of recruitment and social support,
• to the corresponding unit of another law enforcement agency (National Guard, DPSU), regardless of the applicant's place of registration.

The application can be submitted personally or through a legal representative under a notarial power of attorney

How is the one-time cash benefit distributed between relatives?

A frequent question is how funds are distributed between relatives. 

• One-time cash assistance is assigned and paid in equal shares between family members, parents and dependents of a fallen (deceased) serviceman, conscript and reservist.
• If one or more persons entitled to compensation for those killed in war refuse to receive it, or if they have not exercised this right within three years from the date of its occurrence, their shares are distributed among other persons entitled to compensation. 

By the way, payment is made regardless of whether other persons exercised this right.

Who pays the one-time monetary aid to the families of the fallen defenders of Ukraine?

OGD is appointed and paid by the Ministry of Defense of Ukraine, other central bodies of executive power that manage military formations and law enforcement bodies, as well as state authorities, military formations and law enforcement bodies in which servicemen, reservists, or those who participated in educational meetings.

The term for which the state must pay compensation for a killed soldier.

According to the current legislation, the package of documents from the relatives of the deceased must be transferred from the district (city) TCC to the regional TCC no later than 7 working days.

In practice, the district TCC can drag out this process for a year or more, explaining this by the long time it takes to receive answers from military units or VLK.

After that, the regional TCC processes the documents, and if the package of documents is complete, forwards it to the Department of Social Security for consideration. The law does not clearly define the deadline for the transfer of documents, which often leads to delays.

The Department of Social Security must make a decision within 30 days - payment to the families of the fallen soldiers and transfer of funds through the district TCC. However, in practice, applications are considered in order of priority, which also affects the terms of payments.

At every stage, we control, demand, encourage or help clients and TCC bodies to speed up the collection and transfer of documents, their consideration within the time limits set by legislation, and not in the order of priority.

It is important that the relatives of the deceased serviceman receive funds as soon as possible, and not wait for years. In addition, it should be taken into account that inflation can reduce the real value of benefits.

Dead military in war. In the event that the payment of benefits to the families of fallen soldiers is delayed.

In order to speed up the receipt of an OGD, you should apply with statements or complaints to the relevant bodies of the TCC to which you have submitted an application. You can also contact the military unit, which is delaying the issuance of documents necessary to resolve the issue of payment.

You can also contact the Human Rights Commissioner of the Verkhovna Rada, the Ministry of Defense and the General Staff.
