The Verkhovna Rada has registered a draft law "On Industrial Policy", which includes provisions on economic reservations. The draft law also envisages the intention to allow individual entrepreneurs to receive economic reservations. We will consider the possibilities of adopting the draft law and the conditions stipulated by the innovations.

How can it function?

On the website of the Parliament, a brief overview of the concept of the possible functioning of the new reservation system after the adoption of the draft law is made:

• There will be a possibility of reservation for each business entity, which will pay an increased military levy in the amount of 20 thousand hryvnias per month for each employee.
• Businesses will pay the military levy, and companies will independently determine who they consider the most critical to reserve, supporting this with appropriate tax documents.
• The possibility of booking is provided for representative offices of international companies and individual entrepreneurs (the latter will be able to make a reservation if they confirm their activity during the last year)
• Government will determine percentage limits (allowed number of reserved workers) and procedures to be followed.

What is provided for FOP?

Project No. 11331-2 proposes to allow booking for FOP and/or their employees, provided that the relevant natural person - entrepreneur is registered in the Unified State Register of Legal Entities and Public Organizations no later than six calendar months before the entry into force of the Law of Ukraine "On the Principles of State Industrial Policy" and the amount of its income during the last monthly tax (reporting) period, is at least three times the amount of the fee for booking conscripts established by the Tax Code of Ukraine.

It is proposed to set the booking fee for FOP in an amount equal to 1,200 tax-free minimum incomes of citizens, or UAH 20,400.

The draft law No. 11331-1 stipulates that the Cabinet of Ministers must approve the procedure for booking conscripts, while the draft law No. 11331-2 sets the amount of the fee at 20,400 hryvnias.
