Alimony: how much will be paid to children in 2024 - legal aid

Alimony is a regular financial payment that one of the parents is obliged to provide for the maintenance of the child, if he does not live with the child. According to the Family Code, parents are obliged to maintain a child until he reaches 18 years of age. However, if necessary, parents may be obliged to pay alimony even after the age of 18, but before the child reaches the age of 23, if the child needs financial support due to education or incapacity.

Amount of alimony in 2024

Child support payments must ensure their harmonious development. Alimony is an important mechanism for protecting the rights of the child after the divorce of the parents. The law specifies that alimony cannot be less than half of the subsistence minimum established for the appropriate age category of the child.

According to the State Budget for 2024, the living wage for children under 6 years old is 2563 UAH, and for children from 6 to 18 years old - 3196 UAH. The minimum amount of alimony per child cannot be less than 50% of the corresponding subsistence minimum. Thus, the minimum alimony for a child under 6 years old is UAH 1,281.5, and for children from 6 to 18 years old – UAH 1,598.

The maximum amount of alimony, in accordance with Part 5 of Article 183 of the Family Code of Ukraine, can reach 10 subsistence minimums per child. This means that one of the parents may be obliged to pay up to UAH 25,630 for a child under 6 years of age and up to UAH 31,960 for a child between 6 and 18 years of age.

What factors affect the amount of alimony

The amount of alimony is determined based on the number of children and is:

  • per child — ¼ of the amount of income;
  • for two children - ⅓ of the amount of income;
  • for three or more children - ½ of the amount of income.

When determining the amount of alimony, the court takes into account:

  • health and financial situation of the child and parents;
  • the presence of the payer of alimony of other children or disabled relatives;
  • other significant circumstances.

Also, the amount of alimony may change depending on the quarter of the year due to changes in the subsistence minimum for children. The payment of alimony can be reviewed and changed upon filing a claim with the court by one of the parents.

From which sources of income alimony is paid

When determining the amount of alimony, the court takes into account:

  • basic salary;
  • pensions;
  • surcharges, salary allowances and bonuses;
  • additional payments for overtime work, work on holidays, non-working days and weekends, as well as vacation pay;
  • rewards;
  • surcharges and state aid;
  • scholarships;
  • payment for the lease of a land plot or land share;
  • other sources of income.

Alimony must be paid:

  • within the terms specified in the executive letter or resolution on the collection of alimony;
  • by the tenth day of the month following the month for which collection is carried out;
  • no later than three days from the day when wages, pensions, scholarships, etc. are paid.

Peculiarities of alimony payments in wartime conditions in 2024

The Verkhovna Rada passed a law that suspends the collection of wages or other income of debtors during martial law, but this does not apply to alimony. Thus, the issue of collecting alimony remains relevant, with the exception of the execution of decisions in the temporarily occupied territories of Ukraine. If one parent defaults on their child support obligations, the other can file a lawsuit to enforce enforcement. In addition, you can apply to the court to change the amount of alimony. Alimony is also collected from military personnel and persons who lost their jobs during martial law. Non-payment of alimony is subject to a penalty of 1% of the amount of the debt for each day of delay, as well as administrative and criminal liability.
