Is it possible to continue military service after reaching the age limit
After reaching the prescribed age, military personnel have the right to be released from service. However, in some cases, it is possible to extend the service for a certain period.
We will explain under what conditions it is possible to continue service after reaching the maximum age.
In which situations a serviceman will not be dismissed from service, even if he has reached the age limit.
The limit age for military service is determined by Part 1 of Article 22 of the Law of Ukraine "On Military Duty and Military Service".
According to part 2 of this article, a serviceman who has high professional training, considerable experience in his position and is recognized as fit for service by the results of the military medical commission, may remain in the service for up to 5 years after reaching the maximum age, if he himself so wishes.
Dismissal process
Within 12 months before reaching the maximum age, servicemen are sent for a medical examination, the conclusions of which are taken into account when deciding on dismissal.
If the decision to continue service is not made, servicemen are subject to dismissal based on documents approved by the Ministry of Defense. Military personnel may not undergo a medical examination if the release is planned based on age.
The decision to continue the service can be made only if there is a conclusion of the military medical commission, received no earlier than 12 months before reaching the maximum age, and on the condition of a serviceman's report. Otherwise, the order to continue the service will be considered illegal.
