CROSSING THE BORDER BY A MAN WITH DISABILITY GROUP 3 - LEGAL SUPPORT
Since the start of the full-scale invasion, men between the ages of 18 and 60 have been barred from traveling abroad. However, there are exceptions.
According to clause 2 of the rules for crossing the state border of Ukraine during a state of emergency or war, persons with disabilities, regardless of group, have the right to cross the border. The number of departures is not limited, and the reasons for departure can be medical treatment, rest, study, work or personal goals.
However, for the departure of a man with a disability of the I, II or III groups, it is necessary to provide documentary evidence of disability and removal from military registration.
Do people with disabilities of the III group have the right to travel abroad in 2024
According to the Rules for Crossing the State Border by Citizens of Ukraine, persons with disabilities of groups I, II and III have the right to travel abroad without restrictions. This means that the presence of the III group of disability allows a conscripted man to freely cross the border during martial law, and the number of crossings is not limited. Grounds for departure of a person with a disability of group III may include treatment, education, rest, work and personal reasons.
From May 18, 2024, after the entry into force of the new law on mobilization, it will be necessary to provide a complete package of documents confirming the III group of disability and removal from military registration in order to cross the border.
Employees of the border service of Ukraine will also check the presence of military registration documents of those who have the right to leave. Thus, men who have a deferral or are excluded from military registration must present documents that confirm these grounds.
The decision on permission to cross the border for men with disabilities is made by representatives of the border service at checkpoints after checking documents.
Traveling abroad for persons with disabilities of group III: what documents are required
In order for a conscripted man to be able to leave Ukraine during martial law, he must be provided with a complete package of documents.
A person with a disability must have and provide the following documents:
- foreign passport;
- certificate confirming the status of a person with a disability;
- certificate of form No. 157-1/o;
- retirement certificate or a document confirming the appointment of social assistance due to disability.
It is important that the disability document was issued in Ukraine; if the 3rd disability group was assigned abroad, departure will not be possible.
In 2024, when crossing the border, representatives of the State Security Service will also demand:
- certificate from the TCC or extract from the TCC protocol on the decision on suspension or removal from military registration;
- military registration document with a record of suspension or deregistration.
Border crossing may be prohibited in such cases
- lack of documents confirming identity and citizenship of Ukraine;
- absence of documents confirming disability of the III group;
- presence of a ban on traveling abroad, established by a court or other body;
- accusation or suspicion of committing a crime.
In case of refusal to leave, the border guards are obliged to provide a written explanation. If the person does not agree with the refusal, he has the right to appeal the decision in court.
