I am Mariya Borevich, your personal lawyer. My primary goal is to help clients find optimal solutions to current legal issues, ensuring reliable protection of their interests. I specialize in family, civil, and military law, which allows me to effectively handle a variety of situations and cases. In family law, I provide support in resolving issues related to divorce, property division, establishing and challenging parental rights, alimony, and child custody. I understand that these matters are often emotionally complex, so I always strive to find the most delicate and fair solutions for all parties involved. In civil law, I assist in settling disputes related to contracts, property rights, compensation for damages, inheritance, and other issues concerning the protection of personal and property interests. Special attention is given to military law — supporting servicemen, protecting their rights and interests related to military service, social guarantees, and legal disputes. This area requires deep knowledge and understanding of the specifics of military service and the legislation regulating it.

  • A military ID card is an official document confirming a person's status as a conscript or reservist. It is the main document for the registration of conscripts in Ukraine and provides information on:

  • Personal data: full name, date of birth, place of residence.
  • Military status: information about military service, military rank, position, military specialty, as well as information about the mobilization reserve.
  • State of health: results of medical examinations that determine fitness for military service.

  • Postponements or exemptions from conscription: notes on the presence of postponements or exemptions from mobilization for various reasons (for example, due to health, presence of dependents).

Question

Why do you need a military ID?

Answer

During mobilization: for registration, enlistment and confirmation of the status of conscript. To obtain deferment or exemption: the military ID card may contain notations for deferment from mobilization or exemption from the draft under certain circumstances. Upon employment: some employers require a military ID to confirm the employee's record.

To obtain a military ticket, you must register at the territorial recruitment and social support center (TCC). If the military card is lost, it can be restored by applying to the TCC with a corresponding application.

The procedure for issuing a military ticket:

  • Preparation of documents: usually, to obtain a military ticket, the following documents are required: passport of a citizen of Ukraine (original and copy), identification code (original and copy), certificate from the place of study or work (if necessary), photographs (usually 3×4 cm, quantity may vary), a medical certificate about the state of health.
  • Appeal to the TCC and SP: it is necessary to apply to the territorial recruitment and social support center (former military commissariat) at the place of registration or residence. A conscript goes through his first registration right there.
  • Passing a medical board: at the beginning of the procedure, a conscript is usually sent to a medical board. It will determine suitability for military service. The results of the medical examination are recorded, and on their basis it is determined whether the citizen is fit for service.
  • Military registration case: after passing the medical commission and submitting all the necessary documents, a military registration case is established for the citizen. Data about him are entered in the register of conscripts.
  • Issuing a military card: if all stages are successfully completed, TCC employees prepare a military card. The manufacturing and delivery process may take several weeks.
  • Obtaining a military ID: after completing all the formalities, the conscript receives a military ID, which should be kept and presented when necessary.

If you have lost your military card or you need to restore it, you should apply to the TCC with the relevant application and supporting documents about the loss, and also go through repeated procedures, which will be established by the collection center.

Obtaining a deferment from mobilization without a military ID can be difficult, since the military ID is the main document that confirms the status of a conscript. However, if you do not have a military ID, there are several possible ways to resolve this issue:

  • Issuing a military ID: If you have not yet received a military ID, the first step is to contact the Territorial Center for Recruitment and Social Support (TCC). You may be issued a temporary document confirming your registration as a conscript.
  • Documents confirming registration with the TCC: if the military card is lost or you do not have it for some reason, based on the data entered in the TCC register, another document can be issued that confirms your status as a conscript (for example, an extract from the registration) . Such a document may be the basis for a postponement.
  • Applying to the TCC for a deferment: After receiving or confirming your registration, you can apply for a deferment. Reasons for postponement can be different — from health to the presence of dependents.
  • Medical indications: if you want to get a deferment based on your health, you need to undergo a medical examination at the TCC commission or a medical institution, which will determine your condition and, if necessary, issue a deferment based on illness or injury.

Getting a deferment without a military ID can be a difficult process, and a military attorney can make it much easier.

Services of a military lawyer, which can be provided by the "Consultant" legal service:

Consultation on the collection of documents: the lawyer will advise which documents can confirm the right to a deferment and what can be submitted instead of a military ticket, if it has not yet been received.

Support at TCC and SP: a lawyer can help you prepare documents and apply to the recruitment center with a request to grant a deferment based on other evidence of your health or family status.

Legal support during the medical examination: If a postponement is required due to a medical condition, a lawyer will help prepare documents for the medical board and ensure that your rights during the examination are respected.

Appealing the denial: If the deferral is denied, a lawyer will help prepare an appeal or challenge the decision by providing additional evidence.

Clarification of rights and responsibilities: the lawyer will explain what to do in case of delays in issuing a military ID, how to obtain a temporary confirmation of status, and how to avoid violations in the absence of a military ID.

Conclusion

If you have difficulties with the application for deferment, it is recommended to contact a military lawyer. A military lawyer can provide important legal assistance in the process of obtaining a deferral, ensuring the correctness and timeliness of the preparation of documents. He will help you to complete the documents correctly and ensure that your rights are respected in the process of obtaining a deferment from mobilization. In each case, it is important to take into account the specifics of the legislation in force at the time of the application. This will help to avoid unnecessary problems and ensure that all documents for obtaining a deferment are correctly completed.
