Issuing a referral to a medical and social expert commission (MSEC) is an important process for Ukrainian citizens who need to establish a disability or confirm their ability to work. This procedure has become especially relevant in the context of active military operations, when the issue of referral to the MSEC becomes extremely important for military personnel, as well as employees of enterprises and organisations. Below, we will review the full list of documents for referral to the MSEC, the grounds for its execution, the terms and form of referral.

What is the MSEC and what are its functions?

The MSEC is a medical and social expert commission tasked with assessing a person's health status to determine the disability group or the possibility of continuing work. The commission also determines the need for additional assistance, such as rehabilitation measures or social support. The main functions of the MSEC include:

• determining the presence and level of disability;
• assessing the person's ability to work;
• development of recommendations for treatment and rehabilitation.

 Grounds for referral to MSEC :

A referral to the MSEC is issued on medical, social or professional grounds when a person has significant disability or needs social protection. The main grounds for referral to the MSEC include:

1. Chronic illnesses - when treatment does not lead to full recovery and there is a need to establish disability.
2. Injuries - especially in cases where injuries have caused disability.
3. Military injuries - this applies to military personnel who have been injured in combat.
4. Occupational diseases - referral of an employee to MSEK has been exposed to occupational risks at work that have significantly affected his or her health.

For referral to the MSEC, it is important to collect the necessary package of documents that will allow the commission to objectively assess the applicant's health status. The main documents for referral include:

• Medical record - a complete medical examination and extracts from medical institutions on the course of treatment.
• Extracts on the results of treatment - including all previous medical reports and examinations.
• Identity documents - a passport or other document confirming the applicant's identity.
• Referral to the MSEC from the attending physician or medical institution.
• An accident report (if available) - if the disability is related to an accident at work or military action.

 Making a referral to MSEC of a military serviceman :

Special attention should be paid to the process of referral to the MSEC for servicemen and women who were injured in the line of duty. In particular, a serviceman must apply to a military medical institution, which, based on the results of a medical examination, issues a referral to the MSEC. If the medical institution confirms the need to establish a disability, the serviceman receives a referral form, which he must submit to the relevant MSEC commission.

 How to get a referral for MSEC ?

The procedure registration of referral for MSEC consists of several stages:

1. Consultation with a doctor: The applicant must contact his or her doctor, who provides advice, conducts an examination and, if there are appropriate indications, issues a referral.
2. Obtaining an extract from the medical record: The doctor prepares an extract from the medical record, adds the results of examinations and recommendations.
3. Making a referral: The doctor draws up an official document - a referral form to the MSEC, which contains all the necessary data for further consideration by the commission.

Terms of referral to the MSEC

The timeframe for referral to the MSEC may vary depending on the applicant's health condition. As a rule, the timeframe does not exceed 30 days from the date of the visit to the doctor to the referral to the commission. In cases of military injuries or other emergency situations, this period may be reduced.

 Referral form per MSEC :

 Referral to MSEC form must be made in accordance with the established standards and approved forms. In particular, filling in a referral per MSEC :

• The applicant's full name.
• Information about the place of residence.
• Medical indicators and previous examinations.
• Doctors' conclusions on the state of health.
• Signature and seal of the medical institution issuing the referral.

Stages of passing the MSEC

1. Submission of documents to the MSEC: The applicant must provide all the necessary documents, including a doctor's referral.
2. Health assessment: The MSEC commission examines the applicant and analyses the provided medical documents.
3. Decision-making: After the examination, the commission makes a decision on the disability group or other indicators of working capacity.

Rights and obligations of the applicant when being referred to the MSEC :

The right to a medical examination - every applicant has the right to receive a medical consultation and undergo a medical examination before being referred to the MSEC.

The right to appeal the decision - if a person does not agree with the decision of the commission, he or she has the right to appeal or go to court.

Obligation to submit a full package of documents - the applicant is obliged to provide all the necessary documents for an objective consideration of his/her case.
