The MMC (military medical commission) is a special commission consisting of doctors of various specialties and military medics. It assesses the health status of citizens subject to mobilization or military service and determines their suitability for military service.
The main functions and tasks of the MEC are:
assessment of the state of health;
determining the category of fitness;
determination of deferment from mobilization or military service;
exemption from service for health reasons;
checking the state of health after injuries or illnesses.
Absence from the military medical commission (MMC) for a long period of time may have different legal consequences depending on the specific circumstances and the legislation applicable in Ukraine. As a rule, absence from the MTC is not a ground for a fine, but it may lead to other consequences, such as:
- Violation of the obligations of a person liable for military service: persons liable for military service must undergo a VLC during mobilization or at the request of the TSC (Territorial Center for Recruitment and Social Support) to determine their fitness for service. If you do not appear for the CMC without valid reasons, this may be considered a violation of your duties and, as a result, you may be obliged to undergo the CMC and bring your documents in line with the registration of persons liable for military service.
- Possible imposition of a fine or administrative liability: an administrative fine may be imposed for violation of the obligations of a person liable for military service, in particular for failure to undergo a VLC or for late updating of data in the TCC. For example, evasion of mobilization-related duties is subject to administrative liability under the Code of Administrative Offenses of Ukraine.
- Transfer to the reserve or deregistration: if you have not undergone the CMC for a long time, you may be transferred to another category, for example, to the reserve or deregistered as a person liable for military service, if your health condition allows it. In this case, you will not be subject to mobilization.
- Complications of mobilization: if you have not undergone a preliminary medical examination and this is revealed during mobilization, you may have difficulties in obtaining a deferment or exemption from service due to your health condition. To do this, you will need to undergo a medical commission to determine your fitness.
If you have not passed the VLK for a long time, you should contact the TCC as soon as possible, find out why you have not been registered for the commission, and agree on the issue of passing the VLK now. If you receive a fine or claims, you can contact a lawyer to appeal the fine or other sanctions if you have reason to believe that they are unjustified.
Thus, there is no direct fine for not having been on the military registration and enlistment commission for 10 years, but there may be other legal consequences, including fines for violations of military registration. It is important to contact the MCC and go through the procedure to avoid trouble in the future and to involve a lawyer in the case.
A military lawyer can provide several important services if you have not undergone a military medical commission (MMC) for a long time, for example, 10 years.
Services of a military lawyer of the “Consultant” legal service, which may be useful in such a situation:
- Consultation on rights and obligations: a lawyer can explain what legal consequences may arise due to failure to undergo the VLC and whether there are risks for you in this regard. He or she will also explain whether you are subject to mobilization or how you can remedy the situation if you have not undergone the VLC.
- Assessment of the legality of the MCC's requirements: a lawyer can check whether the MCC legitimately requires you to undergo a VLC after a long time and whether there are any errors in your documentation. He or she can also check whether all legal procedures have been followed by the TCC.
- Assistance in organizing the VLK: if you are required to undergo a VLK after a long period of absence from the commission, a lawyer can help you with the preparation of all necessary documents and the organization of the VLK.
- Appealing against unlawful decisions or actions of the TCC: if it is found that you were unlawfully prevented from undergoing the VLK or your rights were violated (for example, if you had legal grounds for deferral or dismissal), a lawyer can file an administrative complaint or a lawsuit in court.
- Preparation of documents for appealing against fines or administrative violations: if you are facing a fine or administrative liability for not attending the VLK, a lawyer will help you draft and file an objection or complaint against the fine. He or she can also represent you in court, if necessary.
- Assistance in obtaining a deferment or exemption from service: if you have grounds for a deferment (e.g., health, family status, etc.), a lawyer will help you prepare documents to submit to the MCC for a deferment or exemption. He or she can collect medical certificates and documents confirming your grounds for release and submit them to the relevant authorities.
- Protection of rights in case of unlawful mobilization: If for some reason you have not passed the CMC and they try to mobilize you forcibly, a lawyer can defend you in court or other authorities. He or she can file a lawsuit or complaint if the mobilization is illegal.
Question
How can a lawyer help in specific situations?
Answer
If you did not undergo the HCVC due to your health condition: a lawyer will help you collect medical certificates, draw up the correct documents to confirm your health condition and secure a deferral from mobilization. If you are accused of evading mobilization: a lawyer will provide defense if you have not undergone a preliminary medical examination and face criminal liability. If you want to avoid a fine for violation of registration: a lawyer will help you appeal against fines and help you file a complaint with the relevant authorities.
If you decide to contact a lawyer, provide him or her with all the information about your situation, including documents from the MEC, medical certificates, information about your marital status and any other documents that may be relevant to your case. In this way, a military lawyer can help you at every stage of the process, from advising you on your rights to representing you in court and helping you organize the MEC. If the case goes to court (for example, in case of appealing against the decisions or actions of the MCC), the lawyer can represent your interests in the trial. A military lawyer of the Consultant legal service can help with evidence, preparation of arguments and defense strategy. If you want to undergo a MEC for deferment or exemption from service, a lawyer can help you prepare for the medical commission by collecting the necessary documents and certificates confirming your health status.
