How the system of automatic recording of violations of traffic rules 

The system of automatic fixation of administrative offenses in the field of road safety consists of a network of technical means (cameras and sensors), which provide automatic photo and video fixation of events with signs of offenses. These devices recognize the license plates of vehicles and transmit information about fixed events to the automated data processing system of the Ministry of Internal Affairs of Ukraine.

The placement of technical means of the system is possible in emergency and hazardous areas or places of concentration of road accidents on public roads of national importance by the decision of the owners of such roads and in agreement with the relevant bodies of the National Police.

The penalty penalty is imposed depending on how many km/h was exceeded. According to the current legislation of Ukraine, the amount of the fine for speeding depends on the degree of violation: for exceeding by 20-50 km/h a fine for exceeding in the amount of 340 UAH, and for exceeding more than 50 km/h-UAH 1700. In Ukraine, drivers may be paid 50 percent of a fine if it is paid within 10 banking days from the date of receipt of the resolution.

The procedure for forming and obtaining a resolution on the imposition of a fine

After fixing the violation, the information comes to the Center for Automatic Fixing Data Processing Center. 

The process of forming a resolution includes:

• Data processing: analysis of photo and video materials, license plate recognition.
• 
  Installation of the offender: use of the Unified State Register of Vehicles, Information Systems of the State Border Guard Service of Ukraine and other resources for identification of the owner or proper user of the vehicle.
• 
  The decision is made: after confirmation of the fact, the resolution is printed and sent within three days by registered letter with a notification of delivery at the address of registration of the owner of the vehicle. 
   

How to avoid false penalties

To avoid false fines, drivers should follow the following recommendations:

• Regularly check for fines. Drivers can find out about speeding fines through official sources such as Action Portal or Mobile App.
• 
  Carefully study the photo fixation. If you have a fine for speeding, you should check the photo fixation for errors.
• 
  Challenge false penalties. If the fine is false, the driver has the right to challenge it through the appropriate authorities.
   

Pursuant to Article 14-1 of the Code of Administrative Offenses (Code of Administrative Offenses), in the case of fixing the violation in an automatic mode, the owner (co-owner) of the vehicle is responsible.

If the other person uses your car regularly, it is necessary to arrange it as a proper user in the Register of the Ministry of Internal Affairs of Ukraine. This will help to avoid penalties for traffic violations, recorded by automatic fixing cameras, which by default come by the car owner.

In Ukraine, it is possible to draw up a proper user online through the application or the Action of the Action, where the car owner applies and the user confirms the request. Alternatively, this can be done offline at the Ministry of Internal Affairs Service Center, where both parties submit the relevant statement. This requires a passport or ID card, identification code, a certificate of registration of a vehicle and, if necessary, a contract of use.
