In 2024, a client approached me — a Ukrainian citizen of conscription age who was mobilized but, due to health conditions and dependents, had a legal right to a deferment from mobilization. The goal was to protect the client’s rights and ensure the lawful processing of the deferment.
I got involved at the stage when the draft notice was handed over, and the client did not know how to act or where to turn to arrange a deferment. It was necessary to collect medical certificates, confirm family circumstances, and prepare appropriate documents for judicial appeal if the administrative level refusal was received.
What steps help to obtain a deferment from mobilization?
- Consultation and document collection. Client’s documents are analyzed; medical certificates, birth certificates of children, and documents confirming family support are collected.
- Submission of the deferment application to the military commissariat. Preparation and submission of official applications with necessary supporting documents.
- Appealing refusal of deferment. If the military commissariat refused, a lawsuit is prepared to recognize the deferment, with additional evidence collected.
- Representation of the client’s interests in court. Professional presentation of the client’s position, participation in court hearings, and argumentation of legal grounds for deferment.
- Obtaining the court decision and monitoring enforcement. Ensuring the court decision on granting deferment from mobilization is implemented.

Situation: the client received a mobilization notice but has two minor children and a chronic illness that grant the right to deferment.
