Unfortunately, in today's realities, the topic of mobilization is quite a trigger for many citizens of our country.
We should talk about the TOP-3 most relevant violations committed by representatives of the TCC and SP during mobilization activities:
1. Forcible detention of citizens on the street
The situation: the biggest resonance in society is caused by the detention of persons during the delivery of summonses. We usually learn about such situations from social networks, when a passer-by is captured on video by TCC and SP employees, using forceful techniques.
❗️ It is important to remember:
• there are grounds for detention only in respect of persons who have committed offences;
• only police officers have the authority to detain and use force;
• in most cases, forceful detention occurs as a result of "verbal confrontation" with representatives of the TCC and SP.
What recommendations should be followed in case of use of force by TCC and SP employees:
• at the first opportunity, seek help from law enforcement agencies and obtain the services of a lawyer;
• in a situation where you are confused, inform your relatives and colleagues about what happened, as they can arrange the help of a lawyer and law enforcement agencies;
• when communicating with TCC employees, do not behave aggressively in order to control the situation and avoid aggravating circumstances.
2. Ignoring existing grounds for deferment in conscripts
The situation: in practice, there are usually cases when deferral documents are simply put aside and TCC and SP employees pretend that they have not seen them or immediately report the insufficiency of existing deferral documents or their defects (missing three seals and other) and provide time to eliminate such deficiencies. In both situations, the conscript is eventually mobilized, justifying this by the fact that he did not provide the proper documents on deferment from mobilization.
Recommendations before going to the TCC and SP:
• independently analyze the existing documents about the postponement or a lawyer will help to make a legal analysis of the situation;
• consult with the legal service at your company or organization;
• collect a complete package of documents that grant the right to postponement and send them to the address of the TCC and SP by means of postal communication through Ukrposhta, necessarily by a valuable letter with a description of the attachment and a notice of delivery (courier delivery).
3. A frivolous attitude towards the health of conscripts
The situation: there are cases when, during the medical examination, the employees of the TCC and SP may take lightly the chronic diseases of the conscript, his real state of health, which may be the reason for exemption from mobilization or the subject of special attention during allocation to a certain type troops
Recommendations:
• in parallel with passing a medical commission at the TCC and SP (or before it), undergo a health check-up at other private or communal health care institution in order to have an alternative opinion about your health and, if necessary, use it as additional evidence.
In any case, before visiting the TCC and JV, we recommend that you seek advice from a qualified lawyer or lawyer in order to avoid legal proceedings.
