According to the legislation of Ukraine, family members of a deceased serviceman have the right to a pension in the following cases:
1. Pension regardless of age: This applies to persons who are entitled to a pension but have not yet reached retirement age.
2. Early age pension: This category includes persons who, under certain conditions, have the right to receive a pension before the established retirement age.
3. Age pension on preferential terms: Some categories of persons may be entitled to pension on preferential terms, for example, combatants, disabled persons and others.
4. Pension with a reduction of the retirement age in accordance with the law: In some cases, if there are appropriate grounds, the retirement age may be reduced in accordance with the legislation, which allows receiving a pension earlier.
5. Persons with disabilities: Persons with disabilities are also entitled to a pension depending on the level and category of disability.
According to the Law of Ukraine "On pension provision of persons released from military service and certain other persons", the relatives and spouse (husband) of the deceased breadwinner have the right to a pension.
The law gives this category of persons the right to pension in the event of the death of a serviceman in connection with the performance of official duties. This means that if a serviceman died while performing military or service duties, his relatives (parents) and spouse (husband) are entitled to pension.
The specified law establishes conditions and procedures for assigning and paying pensions to these categories of persons. The detailed conditions and amounts of pensions can be determined by the law itself, as well as by additional regulations.
