Ukraine has various types of military pensions for persons who served in the Armed Forces, other military formations and their families. Determining the amount of military pension is based on several factors, such as military rank, length of service, age and other criteria. The main legislation that regulates the calculation of pensions for servicemen who are discharged from military service is the Law of Ukraine "On pension provision of persons discharged from military service and certain other persons". This law defines the rights and responsibilities of military personnel in the field of pension provision, the conditions for awarding and the amount of pensions, as well as the mechanisms and procedures for their accrual and payment. It contains provisions for various categories of servicemen, including those in conscript service, contract military service, and provisions for pensions for servicemen who were disabled or who died or were known in system-wide searches. Resolution of the Cabinet of Ministers of Ukraine dated February 21, 2018No. 103 "On recalculation of pensions for persons discharged from military service and certain other categories of persons" provides for the recalculation of pensions assigned in accordance with the Law of Ukraine "On pension provision of persons discharged from military service and certain other persons" until March 1, 2018 .
From July 1, 2021, a monthly supplement in the amount of 2,000 hryvnias will be established for persons who were granted a pension until March 1, 2018 in accordance with the Law of Ukraine "On pension provision for persons released from military service and certain other persons" (except conscripts). This additional payment will be taken into account during further increases in the amount of pensions determined in accordance with Articles 13, 21 and 36 of the specified Law.
Therefore, persons who receive a pension in accordance with the specified conditions will have the right to an additional payment in the amount of 2,000 hryvnias from July 1, 2021. This supplement increases the total amount of their pensions and will be taken into account during future indexations or changes in the amount of pensions that may be carried out in accordance with the legislation.
We have the following situation as the basis for recalculating pensions for military personnel and other persons entitled to a pension:
Availability of documents in the pension case and additional documents: Recalculation can be carried out on the basis of the available documents in the pension case. If the pensioner submits additional documents that confirm the right to increase the pension, then these documents are also considered, and if they meet the requirements of the current legislation, the pension can be transferred in accordance with these additional documents.
Increase in the financial support of the relevant categories of military personnel and other persons: If provided for by the relevant government decision or regulatory act, which establishes an increase in pensions for certain categories of military personnel or other persons, this may also be the basis for recalculating the pension.
Therefore, the recalculation of pensions can take place both on the basis of existing documents and on the basis of submitted additional documents, as well as as a result of increasing the financial support of the relevant categories of persons in accordance with the established regulations.
