Family members of military personnel and other persons entitled to a pension under the relevant legislation may have a number of pension benefits and supports aimed at their social protection. Such benefits may include:
Allocation of early age pension for parents of military personnel and other persons who died or died as a result of the performance of military duties.
Pension payments for disabled children, parents and spouses (husbands) of servicemen in case of their incapacity.
Other benefits and assistance depending on specific circumstances and legal regulations.
If a serviceman was killed, died or went missing, and this is connected with the performance of official duties, his family members have the right to be granted a pension in the event of the loss of a breadwinner. This pension is provided for the purpose of social protection of the families of military personnel who died or died as a result of official duties.
The size of the pension payment for the family of the deceased Ukrainian soldier will depend on the specific conditions and current legislation of Ukraine. Thus, according to the Law of Ukraine "On pension provision of persons discharged from military service and certain other persons", the parents and spouse (husband), children of the breadwinner who died in the line of duty have the right to a pension. This pension is assigned in accordance with the procedure established by law and is one of the forms of social protection for families of military personnel.
The following categories of persons are assigned a pension regardless of whether they are dependent on a breadwinner:
Disabled children.
To disabled parents and spouses (husbands) of servicemen and persons entitled to a pension under this Law who died, died or went missing during the period of service or later as a result of injury, contusion, mutilation or disease that occurred during service.
According to the mentioned Law, the amount of the pension payment is 70% of the salary of the deceased breadwinner to his family members. This payment is intended as compensation for the loss of a breadwinner who died in the line of duty or in defense of the Motherland. The conditions for receiving such a pension include reaching the age of 55 years for men and 50 years for women, provided that there is at least 25 years of insurance experience for men and at least 20 years for women. This is aimed at providing social protection for the parents of dead or deceased servicemen who became disabled or died as a result of participating in military operations or performing military duties.
So, if there are two or more children in the family, the amount of the pension payment is distributed equally between the children, that is, each child receives 50% of the salary of the deceased breadwinner. This is provided to ensure equal rights and social protection for every child in the family.
According to the legislation, family members of a serviceman have the right to receive pension payments in the event of the death of a serviceman, which is not related to the performance of official duties. The size of this pension will be 30% of the salary of the deceased for each family member.
Pensions of the family of the deceased are aimed at ensuring social protection of these persons in case of loss of a breadwinner.
