According to Art. 210 of the Code of Ukraine on Administrative Offenses, violation of the military accounting rules by conscripts, conscripts, and reservists leads to the following consequences:
The first violation of these rules is punishable by a fine of thirty to fifty tax-free minimum incomes of citizens (510-850 UAH).
A repeated violation within a year after an administrative fine for violation by conscripts, conscripts, and reservists of the rules of military accounting or committing such a violation during a special period is punishable by a fine of fifty to one hundred tax-free minimum incomes of citizens (850-1700 UAH).
It is worth noting that currently a special period is in effect in Ukraine, which is a qualifying feature in case of violation of the rules of military registration.
Rules of military accounting, for violation of which administrative responsibility is established
According to the Military Registration Rules, conscripts, conscripts and reservists must perform certain duties. Let's take a closer look at them.
Place of registration:
Conscripts, conscripts and reservists (hereinafter referred to as persons) must be registered in the military register at their place of residence or place of work (study).
If a person leaves Ukraine for a period of more than three months, he must be registered at the place of consular registration in foreign diplomatic institutions of Ukraine.
Arrival on call:
Persons are obliged to arrive upon summons at assembly points, conscription stations, territorial recruitment and social support centers within the time limits specified in the received documents (mobilization orders, summonses, orders) of the relevant authorities. This is necessary for military registration, determination of appointment for a special period, registration of military registration documents, medical examination and referral to training.
Change of residence:
From the moment of the announcement of mobilization and during wartime, persons cannot change their place of residence without the permission of the relevant head of the territorial recruitment and social support center.
Medical examination and treatment:
Individuals must undergo medical examination and treatment in accordance with the decisions of enlistment commissions, conscription commissions, military medical commissions and other medical organizations. This is necessary to determine fitness for military service and general health.
Preparation for military service and reserve service:
Individuals must undergo training for military service, military service, and perform military duty in the reserve. This includes education, training and other activities to be ready for military service.
Removal from military registration upon change of residence:
Individuals must personally come to the relevant authorities (district territorial recruitment and social support centers, SBU bodies, units of the Foreign Intelligence Service) to be removed from military registration when changing their place of residence and to be included in military registration.This is necessary if a person moves to another area, outside of Ukraine to a permanent place of residence or for a period of more than three months.
Notification of change of personal data:
Individuals must personally notify (within a seven-day period) the authorities in which they are on military registration about changes in personal data specified in military registration documents.
They must also provide documents confirming the right to deferment from conscription for military service during mobilization.
Notification of the loss of a military registration document:
Individuals must immediately report the loss of a military registration document to the appropriate authorities. This will help to avoid unforeseen situations and keep military records up-to-date.
Clarifying your personal data:
Individuals must check their personal data with the registration data of district (city) territorial recruitment and social support centers, SBU bodies and divisions of the Foreign Intelligence Service at least once every five years.
Notification of reasons for postponement:
Individuals must submit documents confirming the right to a deferment from conscription for conscription to the district (city) territorial centers of recruitment and social support every year by October 1.
Arrival at the conscription station without receiving a summons:
If the summons of the district (city) territorial center of recruitment and social support has not been received, citizens of conscription age must arrive at the conscription station within ten days from the day of the start of the corresponding regular conscription for military service, determined by the decree of the President of Ukraine.
Who examines cases of violation of the rules of military registration by conscripts, conscripts and reservists?
Cases of violation of the rules of military accounting by conscripts, conscripts and reservists are considered by the heads of territorial recruitment and social support centers.Since cases of administrative offenses must be considered in the presence of a person who is brought to administrative responsibility, the state authorized the territorial recruitment and social support centers to contact the National Police authorities to deliver such persons to the relevant TCC and SP.
