The Cabinet of Ministers proposes new rules for vacations for obtaining higher education
Government draft law "On amendments to some laws of Ukraine regarding the development of individual educational trajectories and improvement of the educational process in higher education" dated October 23, 2023 No. 10177 is designed to significantly change the situation in higher education. It is worth noting that this project also provides for a change in the procedure and conditions for granting the corresponding vacations.
Thus, in the Law of Ukraine dated November 15, 1996 No. 504/96-VR "On Leave" it is proposed to rewrite Article 15, which regulates leave in connection with studies for professional pre-higher and higher education. Therefore, the following additional paid vacations are offered to employees who successfully complete professional pre-university and higher education through distance, evening and correspondence forms of education without interruption from production:
1) for the period of orientation classes, performance of laboratory work, taking tests and exams for students of the first and second years:
– vocational pre-university education with an evening form of education — 10 calendar days;
– higher education with an evening form of education — 20 calendar days;
– vocational pre-university, higher education with correspondence form of education — 30 calendar days;
- professional pre-higher, higher education with a distance form of education — 14 calendar days.

2) for the period of orientation classes, performance of laboratory work, passing of assessments and exams for applicants of the third and following courses:
– vocational pre-university education with an evening form of education — 20 calendar days;
– higher education with an evening form of education — 30 calendar days;
– vocational pre-university, higher education with correspondence form of education — 40 calendar days;
- professional pre-higher, higher education with a distance form of education — 14 calendar days.
3) 30 calendar days for the period of attestation for applicants of vocational pre-university and higher education;
4) for the period of preparation and defense of qualifying work for students who obtain professional preliminary education by distance, evening and correspondence forms of education — two months, higher education — four months.
The duration of additional paid vacations for employees who obtain a second (subsequent) higher education by correspondence (evening, distance) form of education want to be determined as for persons who obtain a higher education in the third and subsequent courses.
Employees allowed to take entrance exams to graduate school with or without a break from production are offered an additional paid vacation once a year at the rate of 10 calendar days for each exam to prepare and take the exams.In turn, employees who study continuously in post-graduate studies and successfully complete an individual training plan will be able to receive an additional paid vacation of 30 calendar days and, at their request, during the four years of study, one free day per week with payment in the amount 50% of the employee's average salary.
The legislation will be able to establish a different duration of vacations in connection with studies for employees who obtain higher education through distance, evening and correspondence forms of obtaining education, where the educational process has its own characteristics, the draft law states.
Pay attention! The proposed regulations on vacations refer, in particular, to correspondence and evening forms of education. While draft law No. 10177 generally provides for the rejection of these forms. On this occasion, the head of the parliamentary subcommittee on higher education of the Education, Science and Innovation Committee, Yuliya Hryshina, noted: "The decision on the cancellation of correspondence and evening forms of education in Ukraine from 2024 has not yet been adopted. The relevant draft law was approved by the Cabinet of Ministers. Further, it must be approved by the relevant Committee, and the VRU must be supported by a majority of votes."
According to her, it is time to review the wording and content of forms of education that do not meet the needs of the time, such as correspondence. "Remote form is a really effective approach that has demonstrated effectiveness. But, for example, will this form of training be suitable for the military? Even now, military personnel who fight at the front continue to study.And here there is a discussion about the correspondence of the content of the forms of education to modern living conditions, and not the cancellation of only one," Grishina emphasized.
