Patent law in Ukraine is one of the key components of the intellectual property system. It regulates the rights of inventors and patent owners, as well as determines the procedure for obtaining patents and their protection. In this article, we will consider the basics of the legal understanding of patent law in Ukraine, including the requirements for patenting, the rights and obligations of patent owners, as well as the processes of patent registration and protection.
1. Requirements for patenting
To obtain a patent in Ukraine, an invention must meet three key criteria:
Novelty: The invention must be new, that is, not known from the state of the art before the date of filing the patent application.
Inventive level: The invention must be non-obvious to a person skilled in the art, i.e. contain elements of novelty and originality.
Industrial applicability: The invention must be applicable in industry or other fields.
2. Patent registration process
Patent registration in Ukraine is carried out through the National Intellectual Property Office (NIPO). The registration process includes:
Submission of an application: The application must contain a description of the invention, drawings (if necessary), claims and an abstract.
Preliminary examination: NOIP carries out a preliminary examination of the application for compliance with formal requirements.
Examination: After the preliminary examination, the main examination is conducted, which checks the novelty, inventive step and industrial applicability of the invention.
Issuance of a patent: If the invention meets all the requirements, the patent is issued and published.
3.Rights and obligations of patent owners
