I am your personal lawyer. My goal is to help the client find the best solutions for current legal issues.

Child support is financial support that one of the parents (or both) is obliged to pay for the support of their child after a divorce, as well as in cases where the parents do not live together. These funds are intended to cover the child's basic needs, such as housing, food, clothing, medical care, education, etc.

The amount of alimony is established in accordance with the legislation of the country, and can also be determined by an agreement between the parents or decided by the court in case of disagreement between the parties. This amount usually takes into account the income and ability of the parents, as well as the needs and costs of supporting the child.

The payer of alimony can pay it directly to the other father (or mother) who provides for the maintenance of the child, or through social security authorities, if this is provided for by law.

It is important that parents honor their child support obligations, as this ensures the financial stability and well-being of the child. In case of non-fulfillment of obligations regarding the payment of alimony, appropriate legal measures may be applied to collect them.

An alimony agreement is a legal agreement between the parents (or guardians) of a child regarding the payment of alimony for its upkeep. This document establishes the rights and obligations of the parties regarding the financial support of the child.

Why conclude an agreement between parents on the payment of child support. The conclusion of an agreement between the parents on the payment of child support can be useful for solving financial issues related to child care.

However, it is important to keep in mind that such an agreement cannot contradict the law and cannot release the father (or parents) from the legal obligation to pay child support.

Here are some key points that can be included in such a contract:

Amount of child support: The agreement may specify the amount of child support that the parent (or parents) agrees to pay for the child. This amount can be determined as a percentage of income or set as a specific amount.

Payment terms: The agreement may include terms on the regularity and terms of alimony payments.

Rights and obligations of the parties: The contract can define the rights and obligations of each parent regarding the payment of alimony and the obligation to fulfill them.

Right of Subrogation: The agreement may specify whether the father has the ability to transfer his rights to alimony payments to a third party in the event that he is unable to fulfill his obligations.

Enforcement: The agreement may include provisions for the application of enforcement measures in the event of failure of either party to fulfill its obligations under the agreement.

Other conditions: Depending on the specific needs of the parties, other conditions may be included in the contract as they deem necessary.

The child support agreement must be in writing and can be signed by both parents or approved by the court. It is an important tool for ensuring the financial well-being of the child after the divorce of the parents.

Despite the conclusion of an agreement on the payment of child support, it is important to keep in mind that in case of any conflict situations, the parties can still go to court to resolve the dispute.

There is also a practice when alimony is collected for a child with a disability. This is the financial support that one parent (or both parents) is obliged to pay for the upkeep and needs of a child with a disability. They aim to provide appropriate conditions for the development and well-being of such a child.

The amount of alimony for a child with a disability can be determined taking into account his special needs and expenses related to medical care, medicine, rehabilitation, education, transport, etc. The amount of alimony can be determined individually for each family, depending on their financial status and capabilities.

In order to receive alimony for a child with a disability, it is usually necessary to submit an application to a court or a social welfare body. The court or the relevant body will decide on the amount of alimony, taking into account all the circumstances of the case and the needs of the child.
