There are instructions for conducting examinations for the level of proficiency in the state language
The National Commission for State Language Standards has approved the Instructions for holding examinations for the level of proficiency in the state language.
The relevant decision No. 426 of November 22, 2023 entered into force on February 21, 2024.
The approved Instructions determine the scope of rights and responsibilities of the applicant, examiner, and instructor during the exam to determine the level of proficiency in the state language, which is conducted and organized by the National Commission for State Language Standards (hereinafter referred to as the Commission) in order to ensure compliance with the requirements of the Law of Ukraine on April 25, 2019 No. 2704-VIII "On ensuring the functioning of the Ukrainian language as the state language" (hereinafter - Law No. 2704) and Resolution of the Cabinet of Ministers of April 14, 2021 No. 409 "On approval of the Procedure for conducting examinations for the level of proficiency in the state language" (hereinafter - Resolution No. 409) .Rights and obligations of the applicant
The applicant has the right to:
• unbiased attitude towards oneself;
• registration for an exam on the level of proficiency in the state language;
• free access to the electronic cabinet after registration for the exam;
• familiarization with the conditions of the exam and the work schedule of the exam audience;
• familiarization with the requirements for the level of proficiency in the state language;
• familiarization with the exam program, sample tasks for the oral and written part of the exam;
• proper and safe conditions for taking the exam;
• notification of the Commission about the facts that had a significant impact on the result of the exam;
• early completion of the written part of the exam;
• familiarization with electronic protocols of verification after establishing the result of the exam;
• challenging the exam result in accordance with the established procedure;
• use during the exam of additional electronic devices, which are smart devices (for persons with disabilities);
• retaking the entire exam or one of its parts in agreement with the responsible person of the Commission in case of technical failures that make it impossible to determine the result (which the instructor notes in the exam report). Reassembly in the event of a technical failure takes place on a general basis with the receipt of a new version of the tasks;
• refusal to take the entire exam or one of its parts without explaining the reason;
• leaving (if necessary) the place of taking the exam with the instructor's permission and accompanied by the instructor.
The applicant must:
• familiarize yourself with your rights and obligations, these Instructions and follow them;
• arrive on time at the designated exam venue;
• go through the person identification procedure for taking the exam by submitting an identity document (for foreigners and stateless persons) or confirming Ukrainian citizenship (for citizens of Ukraine);
• apply to the Commission with a notification of a real or potential conflict of interest (if any);
• follow all the instructions of the instructor and/or the responsible person of the Commission;
• observe the rules of behavior in a public place.• The applicant is prohibited from:
• bring into the premises dangerous objects and substances that may pose a threat to the life and health of other persons present at the place of the examination, as well as objects that may interfere with the examination;
• violate discipline and generally accepted rules of conduct;
• leave the place of taking the exam without the instructor's permission and accompaniment (at the same time, one candidate may leave the audience accompanied by the instructor);
• have any items on the table other than water, medicine, ID, pens and instructor-issued draft sheet;
• communicate in any form while performing tasks with other applicants or third parties;
• write down answers; use reference books, manuals, textbooks, dictionaries; use any other sources of information on paper or electronic media;
• read previously prepared texts in front of the camera;
• arbitrarily change the topic of the message within the oral part of the exam;
• use means of communication, devices for reading, processing, saving and reproducing information that are not provided for by the examination procedure;

Rights and obligations of the instructor
An instructor cannot be a person who has a bachelor's degree and/or a master's degree in "Philology", "Secondary education" (subject specialty "Ukrainian language and literature") and/or a scientific degree of a doctor of philosophy (candidate of sciences) and/or a doctor of sciences in the specialty (specialization) "Ukrainian language".
The instructor has the right to:
• on an unbiased attitude towards oneself;
• to get acquainted with the rights and obligations of the instructor;
• provide procedural assistance to the applicant during the exam;
• free access to the Instructor's electronic office;
• to pay for the services provided on the basis of the concluded contract.

The instructor is obliged to:
• comply with these Instructions regarding the organization and conduct of the exam;
About an individual approach to setting the work mode
Also, according to Article 172 of the Labor Code, a person with a disability may, at will or according to the requirements of an individual rehabilitation program, have a working regime under the conditions of a part-time working day (part-time working week) and preferential working conditions. If the MSEK recommendations indicate that a person with a disability can work at his position under the conditions of reduced working hours, the employer is obliged to set him part-time working hours at the request of the employee. For this, the employee must submit an application to establish part-time working hours, and the employer must issue a corresponding order.
If the employee does not agree to transfer him to part-time work, the employer does not have the right to unilaterally set him part-time. Part-time working hours can be established by reducing the duration of daily work, the number of working days during the week, or simultaneously by reducing both the number of working hours per day and the number of working days.
The employer is obliged, at the request of the employee entitled to part-time work, to establish working hours of the duration requested by the employee. In these cases, wages are paid in proportion to the time worked or depending on production.
In accordance with Article 56 of the Labor Code, part-time work does not entail any restrictions on the scope of employees' labor rights.
