The range of responsibilities and functions of the State Labor Service will be changed — part of the powers will be transferred to the Ministry of Internal Affairs, the Ministry of Energy, the State Geosurvey, the State Consumer Service
The Committee of the Verkhovna Rada of Ukraine on social policy and protection of veterans' rights held a "round table" meeting on the topic "Prospects and directions of reforming the State Labor Service of Ukraine."
"The State Labor Service is a fairly strong, almost fiscal body after the State Tax Service. The institution strongly influences the work of any business. The State Labor Service is currently responsible for labor protection, the state of affairs with informal employment and the fight against "shadow" employment, said the head of the Committee Halyna Tretyakova in her speech. — The reform of this Service is urgent. We should focus primarily on the problem of informal work. We have to motivate the employer and the employee to switch to formal work."
The Deputy Minister of Economy of Ukraine, Tetyana Berezhna, reported on the development of the draft Law on delimiting the powers of central executive bodies in the field of industrial safety, labor protection, occupational hygiene, handling of explosive materials, state mining supervision, state supervision of compliance with labor and employment legislation .This draft law will allow redistribution of functions between the central bodies of executive power, in particular regarding:
• handling of explosive materials and implementation of state mining supervision;
• conducting a technical investigation into the circumstances and causes of accidents related to the use of gas in households;
• registration and accounting of heavy-duty vehicles and other technological vehicles;
• compliance with advertising legislation.
"The draft law provides for the transfer of these non-core policies for the State Service of Ukraine on labor issues to other executive authorities, in particular, to the Ministry of Internal Affairs, the Ministry of Energy, the State Geological Survey, the State Consumer Service.
In March 2023, the draft legislative initiative was approved by the Government, Tetiana Berezhna reported. — In this way, the Service will be able to concentrate on the key functions provided for by European directives, and direct efforts to combat shadow, informal employment. Every tax paid is very important, especially in times of war. The draft law is being prepared for registration in the parliament."
In his speech, the head of the State Labor Service of Ukraine, Ihor Degnera, noted that the turnover rate among labor inspectors is almost 20% every year, in particular, due to the non-competitiveness of the inspector's salary. Thus, the salary of a newly appointed inspector without civil service experience is currently UAH 5,296.Serhii Bilenkyi, Deputy Chairman of the Joint Representative Body of Employers at the national level on social issues, focused, in particular, on the importance of continuous improvement of the qualifications of labor inspectors and understanding the inspector's responsibility for the quality and objectivity of the orders issued to eliminate violations of labor law requirements. According to him, there are cases of successful appeals against such prescriptions in court, which testifies to the level of expertise of the inspector who makes the corresponding written demand-prescription.
Ihor Degnera said during his speech that among the priority directions of State Labor, in particular, in the conditions of martial law, is the activation of social dialogue and the establishment of cooperation with interested bodies.
Halyna Tretyakova drew attention to the importance of monitoring the fulfillment by business entities of the standard of workplaces for employment of persons with disabilities, as well as determining the list of business entities that are subject to labor legislation.
