Obtaining a temporary residence permit in Ukraine is important in order to ensure the legality and stability of a person's stay in the country, as well as to ensure the development of personal and social opportunities.
A temporary residence permit in Ukraine is issued to persons who are not citizens of Ukraine, but plan to stay in the country for a certain temporary period. Usually, this category of persons includes:
Foreigners: Persons who do not have Ukrainian citizenship, but plan to temporarily live in Ukraine, can obtain a temporary residence permit.
Refugees and persons in need of additional protection: Persons who have received the status of refugees or persons in need of additional protection can also obtain a temporary residence permit.
Persons with a special status, such as students, contract workers, or persons who are in Ukraine under exchange programs: These persons may receive a temporary residence permit to stay in Ukraine for an educational, work, or other temporary period.
Persons who have arrived in Ukraine for official visits or events: Some persons who have arrived in Ukraine for official visits, conferences, cultural or sports events may also receive a temporary residence permit.
The procedure for obtaining a permit:
The procedure for obtaining a temporary residence permit in Ukraine may depend on the specific situation and category of the person submitting the application, as well as on the legislation in force at the moment. However, the general procedure may include the following steps:
Preparation of the necessary documents: A person who intends to obtain a temporary residence permit must collect the necessary documents. This may include a passport or other identity document, as well as documents that confirm the purpose and duration of stay in Ukraine (for example, an employment contract, an invitation letter from a Ukrainian partner, a student card, etc.).
Submitting an application: A person submits an application for a temporary residence permit to the relevant body of the migration service. Usually, it can be a local department of the State Migration Service of Ukraine or a diplomatic representation of Ukraine abroad, if the applicant is outside the country.
Review of the application and submission of documents: After the submission of the application and documents, the competent authorities review them and make a decision on the issuance of a temporary residence permit. The legislation sets a deadline of 15 days for consideration of documents.
Obtaining a permit: In case of a positive decision by the migration service or the consular department, the person receives a temporary residence permit, which allows him to legally stay on the territory of Ukraine for a specified period. It is worth noting that the permit will be valid for one year from the moment of receipt, with the exception of some categories of persons. So, for example, in the case of obtaining a permit by employees, its validity period will be similar to that specified in the employment permit, and if the recipient of the permit is a student, then the permit will be issued for the period established by the order of the educational institution for the period of study of foreign students.
It is important to note that procedures and requirements may differ depending on the specific situation and the legislation in force at the time of application. Therefore, it is recommended to refer to official sources or consult with a lawyer for up-to-date information.
Lawyer services in the process of obtaining a permit:
The importance of the lawyer advice is determined by the complexity of the process of obtaining a permit. The legal services will prepare all the necessary documents, conduct a legal analysis of the situation and the requirements of the legislation, and submit the collected documents to the State Department of Internal Affairs. In case of unjustified refusal, lawyer consultation will help protect your rights both in the pre-trial procedure and by applying to the court.
