Procedure for medical examination of conscripts during mobilization for a special period
Ukrainian conscripts, who are required by law to undergo a medical examination, are subject to a procedure that carefully examines their state of health. This process has two main stages: a peacetime examination and a medical examination during mobilization or for a special period.
The basis for conducting a medical examination
In accordance with the established procedure, a medical examination is carried out by the decision of the heads of TCCs and SPs at assembly points of district (city) TCCs and SPs or in health care institutions by doctors who are included in the composition of the VLK of TCCs and SPs.
Scope and procedure of medical examination
Conscripts are examined by various specialists, including surgeons, therapists, neuropathologists, psychiatrists, ophthalmologists, otorhinolaryngologists, dentists, dermatologists, and, if medically indicated, doctors of other specialties.
Repeated medical examination of conscripts is carried out in accordance with the regulations, once every 5 years. Reserve officers are subject to a repeated medical examination during the regular certification, and reserve, non-commissioned officers and senior officers undergo it in the event of a change of assignment.
Conscripts who are recognized as unfit for military service in peacetime, limited fit in wartime, undergo an additional examination and medical examination. This category of citizens is reviewed by the VLK of district, city TCCs and SPs based on their place of stay on military registration. A doctor, a member of the VLK, sends them for additional examinations, which must be entered into the register of the Electronic Defender Registration System (ESOZ).Before the examination of conscripts, they undergo a comprehensive examination, including laboratory and instrumental studies. In particular, these are blood and urine tests, serological tests for the presence of various viruses. and other studies depending on age and medical indicators. The blood group and Rhesus affiliation are determined, an X-ray examination of the chest organs, and an ECG are performed. Persons older than 40 must have their intraocular pressure measured and blood sugar tested.
Doctors participating in the medical examination are familiar with the medical records in the ESOZ and other medical documents provided to conscripts. On the basis of the received data, they make appropriate entries in the EHS system.
During the medical examination, conscripts are required to provide the TCC and SP with an outpatient medical card, which corresponds to form No. 025/о, approved by the Ministry of Health of Ukraine. In addition, they must also submit extracts from the medical records regarding the suffered diseases, injuries, wounds and other medical information that is not available in the EHIC.
After the examination, the examination and medical examination card for soldiers, sailors, sergeants and foremen is kept in the TCC and SP until the next examination, and for officers, ensigns (midshipmen) - in their personal files.
If the reserve officers previously served in the Armed Forces of Ukraine or other military formations, the TCC and SP indicate in the inspection referral when and for what reason they were released to the reserve, as well as submit a Sickness Certificate or a copy thereof.
Decisions made by the VLK based on the results of a medical examination
After the end of the medical examination during mobilization, the VLK makes one of the following decisions regarding the conscript:
"Fit for military service";
"Temporarily unfit for military service (indicate the date of re-examination)";
"Unfit for military service with exclusion from military registration";
"Limited fitness for military service."
"Suitable (or unsuitable) for military service by military specialty ________________________ (specify specialty)."
The validity period of the decision of the VLK
After the completion of the medical examination during mobilization, the VLK issues resolutions regarding the suitability of conscripts for military service. These resolutions are drawn up with a certificate of the VLK and are valid for one year from the date of the medical examination.
Cases of deferment from mobilization
When the need for treatment due to illness, injury or other conditions requiring leave to recover health is identified, the VLK may decide to grant reserve officers a deferment from acceptance into military service or temporary ineligibility for military service in the case of conscripts. If conscripts who are in the assembly require treatment, they may be declared unfit for further assembly.
In wartime or during mobilization, a postponement of the draft may be granted due to health conditions for a period of 2 to 6 months, depending on the disease and the expected duration of treatment. After the end of this deferral, conscripts undergo a medical examination to determine their suitability for military service.
If it is difficult for the VLK doctors to definitively determine the state of health of a conscript, they can send him to an outpatient or inpatient examination, and then conduct a second examination. If the examination is carried out in military health care facilities, the examination is carried out by a hospital or garrison VLK.
If a conscript needs treatment during conscription or collection, the doctors of the VLK can refer him for treatment, after which he must be examined again.Citizens who have been discharged from military service can apply for a review of the decision of the VLK regarding their suitability for military service. In case of disputed cases, the final decision rests with the Central VLK. For this, relevant medical documents are required, which are stored in the TCC and SP.
The procedure for appealing the decision of the VLK
The procedure for appealing the decision of the VLK ( the procedure for appealing the decision of the VLK ) is regulated by the legislation of Ukraine on appeals by citizens, as well as by the internal instructions of the Ministry of Defense of Ukraine and the Armed Forces of Ukraine.
Appeal the decision of the VLK regional court in an out-of-court procedure must be carried out within the time limit established by law.
Complaints about the actions or inaction of non-staff VLKs are submitted to full-time VLKs in accordance with the administrative and territorial areas of responsibility.
Complaints about the actions (inaction) or decisions of the VLC of district (city) TCCs and SPs are submitted under the authority of the VLCs of Kyiv city TCCs and SPs, regional TCCs and SPs.
Actions (inaction), decisions, resolutions adopted by the VLKs of regional (Kyiv city) TCCs and joint ventures are appealed to the regular VLKs.
Actions (inaction), decisions made based on the results of consideration of appeals by the Regional Regional Council of Ukraine are appealed to the Central Regional Council of Ukraine.
If the complaint is recognized as well-founded, the full-time VLK may review the contested resolution of the VLK or make a decision to refer the person for a repeat medical examination.
