The procedure of adopting a child in Ukraine requires a lot of time and effort. Ukrainian legislation provides for the possibility of adoption of children by citizens of Ukraine living abroad, as well as children by foreigners who are citizens of Ukraine.
Adoption at a consular institution or diplomatic mission of Ukraine: If a citizen of Ukraine wishes to adopt a child who is a citizen of Ukraine, but lives outside the country, the adoption is carried out at the relevant diplomatic or consular institutions of Ukraine, provided that the established procedures are followed.
Permission for foreigners: If the person who wants to adopt a child is not a citizen of Ukraine, this requires permission from the central executive body responsible for the sphere of adoption and protection of children's rights in Ukraine.
Adoption abroad: If a foreigner wishes to adopt a child who is a citizen of Ukraine, on the territory of another country, such adoption is recognized as valid only on the condition of obtaining permission from the central executive body of Ukraine responsible for the sphere of adoption and protection of children's rights.
These rules determine the procedure for adopting children who are citizens of Ukraine and include the following basic provisions:
1. Adoption by a foreigner in Ukraine: Foreigners may adopt a child who is a citizen of Ukraine on the general grounds established by the legislation of Ukraine.
2.Requirements for a child for adoption by a foreigner: For the adoption by a foreigner of a child who is a citizen of Ukraine, the child must be registered with the relevant central executive body for at least one year and reach the age of five.
3. Conditions for adoption before the expiration of the specified period: Adoption can be carried out before the expiration of the specified period, as well as before the child reaches the age of five in certain cases, if the adopter is a relative of the child, the child suffers from certain diseases, or if the adoption includes all siblings and sisters in one family.
4. Conditions of adoption when there is no citizen of Ukraine who is the adopter: If there is no citizen of Ukraine who wishes to adopt a child, a foreigner can adopt a child who is a citizen of Ukraine.
5. The need for the permission of the central executive body: For the adoption by a foreigner of a child who is a citizen of Ukraine, the consent of the relevant central executive body of Ukraine is required.
6. Preservation of Ukrainian citizenship: A child who has been adopted retains his Ukrainian citizenship until reaching adulthood and has the right to preserve his national identity in accordance with international treaties.
The adoption of a child who is a citizen of Ukraine by a person who is a citizen of a state with which Ukraine does not have an agreement on the provision of legal assistance may not be secret in the following cases:
1. If the adoption is not secret in the state in which the adopter permanently resides and to which the child is to move.
2.If a person who is a citizen of a state with which Ukraine does not have an agreement on the provision of legal assistance, and who adopts a child, does not permanently reside in Ukraine.
Thus, consular institutions, on the instructions of the Ministry of Foreign Affairs of Ukraine, can keep records of adopted children living outside of Ukraine and supervise the observance of their rights until they reach the age of eighteen. This helps ensure the protection of the rights and well-being of adopted children outside the country and helps in resolving possible issues that may arise in the process of their upbringing and life in another country.
