Registration of residence permit in EU countries is a pressing issue for Ukrainians. In this article we will consider the issue of obtaining a residence permit in Belgium.
Belgium, as a member of the European Union, offers different ways for foreigners, including citizens of Ukraine, to obtain a residence permit (RP). The process can be complex, but if the established requirements are met, it is quite feasible. Let's look at the main methods:
1. Employment. If you have an offer from a Belgian employer, you can apply for a residence permit for highly qualified workers. The company must initiate the process and prove that you are qualified for the position. You must also have a sufficient level of proficiency in Dutch, French or English.
2. Self-employment/entrepreneurial activity. Ukrainians can obtain a residence permit in Belgium if they plan to open their own business and invest in the Belgian economy. You need to provide a detailed business plan, confirm the availability of the necessary start-up capital and pay social security contributions.
3. Training. Students assigned to accredited Belgian universities are eligible for a student visa to study. After completing your education, it is possible to re-register your status for a residence permit upon employment.
4. Family reunion. If you have close relatives (spouses, minor children) who are Belgian citizens or have a valid residence permit, you can obtain a residence permit under the family reunification program.
5. Other reasons. There are additional routes for certain categories of persons, such as residence permits for refugees/asylum seekers, as well as wealthy investors whose investments in the Belgian economy are considered important.
Also, Ukrainians who fled their country due to the war with Russia can receive temporary protection in Belgium on the basis of refugee or asylum seeker status. There is a simplified procedure for Ukrainian citizens:
- filing an application for temporary protection status. Ukrainians have the right to immediate temporary protection upon arrival in Belgium for 1 year. The application can be submitted to the Office for Foreigners (Office des Étrangers).
- Registration and receipt of a certificate of temporary protection. After submitting documents, Ukrainians register and receive a temporary protection certificate instead of a residence permit.
- rights to a period of temporary protection. Persons with temporary protection have the right to residence, work, education, health care and social benefits in Belgium. The validity period may be extended.
the possibility of further obtaining a residence permit. After the end of temporary protection, Ukrainians can apply for a permanent residence permit under the refugee protection program.
Regardless of the reasons, the process of obtaining a residence permit in Belgium requires careful preparation of documents, interviews and legal support. Important factors:
– adequate financial security to cover travel and living expenses.
- absence of criminal records and violations of migration laws.
- Proficiency in at least one of the official languages (Dutch, French or German).
- documentary evidence of connections with Belgium (work, education, marriage, etc.).
The processing time for applications can vary from several months of a year or more, depending on the circumstances. It is recommended to contact an immigration lawyer for advice on the best path and assistance in preparing the necessary documents. It is also important to comply with established requirements and strings.
