Resolutions of full-time military medical commissions on the degree of fitness for military service can be adopted both on the basis of the results of a medical examination at the MMC itself, and on the basis of a medical examination conducted at a non-staff MMC or on the basis of medical documents submitted for review. The determination of fitness for military service usually depends on a variety of factors, including health, medical history, and other important circumstances.
This list indicates the various degrees of fitness for military service that can be established by the MMC during the medical examination of military personnel and other persons:
1. Suitable for:
- to regular military service;
- to military service under a contract;
- to serve in the military reserve.
2. To prepare for participation in the MO:
- to participate in peacekeeping operations (MO).
3. Before studying in military higher educational institutions:
- to study in military higher educational institutions with the specified specialty.
4. For service in various military units and specialties:
- on submarines, surface ships, in the marines, amphibious assault troops, special facilities, special purpose units;
- for underwater driving of tanks;
- to work with various types of technical and chemical means;
- to training and service in diving units;
- to study and serve in a specific military specialty.
- to serve in security units, educational institutions, medical units and other service units."Unfit for military service with review after 6-12 months" is accepted by the military medical commission during martial law on the basis of specific articles of the Schedule of Diseases. It means that a person is temporarily declared unfit for military service with a possible further review of his condition after 6-12 months.
This may become necessary when a period of time is required to restore fitness for military service, during which a possible improvement in health or the results of treatment is predicted.
Reasons for such a determination may include a variety of medical conditions and illnesses that require a period of time for treatment, rehabilitation, or observation before a final determination of fitness for military service can be made.
"Temporary unfitness" means that a person is temporarily unfit to perform certain military duties, but with the possibility of further review according to specified terms.
1. For servicemen of the Airborne Assault Forces.
2. For divers.
3. For tankers.
4. To work with various types of hazardous materials and diseases.
5. For servicemen of the Navy of the Armed Forces of Ukraine.
6. For conscripts and reservists.
7. For everyone before military service and service in the military reserve.
The decision "unfit for further training" is made for conscripts and reservists who have been called up for training and recognized by the VLK as needing leave for treatment due to illness or after injury (contusions, injuries or mutilations).This decision means that the person is unable to continue meeting due to their health condition and the need for leave for treatment or recovery from an injury.
Appealing the decision of the Military Medical Commission (MMC) can be important for persons who do not agree with the decision regarding their health and fitness for military service. Here are some steps you can take to appeal a decision of the MMC:
1. Appeal to the commission: before filing an official appeal, you can try to appeal directly to the MMC itself for an explanation of the decision. Sometimes this can resolve the matter without the need for a formal appeal.
2. Filing an appeal: if a person does not agree with the decision of the MMC , he can file an appeal or complaint to the military commissariat or military medical department. In the appeal, you should provide detailed reasons why you are appealing the decision of the MMC and present any additional medical documents or expert opinions that support your position.
3. Medical Examination: In some cases, it may be useful to consult independent medical experts for an additional opinion on your health and fitness for military service. Their expert opinion can be used as additional evidence in the case.
4. Filing a complaint to the court: in case of failure to resolve the case at the level of the military commissariat or military medical administration, you can consider the possibility of filing a complaint to the court.
It is important to keep in mind that the procedure for appealing a decision of the MMC may differ depending on the country and jurisdiction. Therefore, it is recommended to contact local legal advisers or authorities for specific advice on appealing the decision of the MMC.
