THE SENDING OF EXECUTIVE PROCEEDING DOCUMENTS FROM ASVP TO ELECTRONIC CABINETS IN ECITS WAS IMPLEMENTED — MINISTRY OF JUSTICE
The Ministry of Justice of Ukraine, together with the State Enterprise "National Information Systems", the State Judicial Administration of Ukraine (hereinafter - the State Judicial Administration of Ukraine) and the State Enterprise "Information Judicial Systems", which belongs to the sphere of administration of the State Administration of Ukraine, implemented the possibility of instant sending of documents of executive proceedings from the Automated System of Executive Proceedings (ASVP) to the Unified Judicial Information and Telecommunication System (JESITS). This was reported by the press service of the Ministry of Justice.

Such a functionality will allow executors to speed up the sending of documents of executive proceedings, and the parties will guarantee their receipt in the electronic office of EUITS directly.
In accordance with the second part of Article 28 of the Law of Ukraine "On Executive Proceedings", documents of executive proceedings are sent exclusively in electronic form to bodies and persons who have electronic offices in EUITS or its separate subsystem (module), which ensures the exchange of documents. In addition, documents of executive proceedings may be sent additionally on the basis of a written request of such persons to their addresses specified in the executive document.
"At the same time, the party to whose electronic office the documents of the executive proceedings will be sent will be considered to have been duly notified of the issuance of the relevant resolution by the executor.The procedure for registering an electronic cabinet is simple and takes place with the help of a qualified electronic signature for both individuals and legal entities," said Deputy Minister of Justice of Ukraine for Executive Service Andrii Haychenko.
The Ministry of Justice drew attention to the fact that in accordance with paragraph 10 of the "Regulations on the procedure for the functioning of individual subsystems of the Unified Judicial Information and Telecommunication System", approved by the decision of the High Council of Justice of August 17, 2021 No. 1845/0/15-21, the registration of electronic offices in ESITS is mandatory for all legal entities, as well as for lawyers, notaries, public and private executors, arbitration managers, judicial experts, state authorities and other state bodies, local self-government bodies. Other persons register their electronic accounts in EUITS on a voluntary basis. In addition, this is stated in the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Regarding Mandatory Registration and Use of Electronic Cabinets in the Unified Judicial Information and Telecommunication System or Its Separate Subsystem (Module) That Ensures the Exchange of Documents" dated June 29 No. 3200-IX of 2023.

Andriy Haychenko noted that the process of sending and receiving such documents will be almost instantaneous.After all, on the part of the executor, the referral will take place at the moment of acceptance (signing) of the document by the executor with a qualified electronic signature in the Automated System of Executive Proceedings.
Therefore, the innovation will simplify the procedure for timely receipt of important documents of executive proceedings, in particular in the conditions of martial law. This will be useful for both the executors and the parties to the enforcement proceedings and will save time and avoid the costs of sending documents by postal means.
