This article of the Criminal Code of Ukraine refers to the illegal possession of a vehicle and defines responsibility for the following actions:
1. Illegal possession of a vehicle. Liability is provided in the event of illegal possession of a vehicle without the use of violence or coercion. The punishment may be restriction of liberty for a period of three to five years or deprivation of liberty for the same period.
2. Illegal possession of a vehicle in more complicated circumstances.This article provides for a more serious responsibility if the illegal possession of a vehicle is committed under certain conditions, such as repeated offenses, complicity of a group of persons, violence or threats, entry into premises, use of electronic devices to interfere with the operation of technical security equipment, and also if the cost of the vehicle means exceeds a certain threshold. The punishment includes deprivation of liberty for a term of five to eight years with or without confiscation of property.
3. Organized illegal possession of a vehicle. Liability under this article applies if the illegal possession of a vehicle is committed by an organized group or under specific conditions. The punishment includes deprivation of liberty for a term of eight to twelve years with or without confiscation of property.
These regulations establish serious consequences for persons who commit illegal possession of a vehicle, especially in cases where the actions are carried out in specific circumstances or with the use of violence.
