The Committee on Law Enforcement Activities recommends that the parliament adopt as a basis a draft law that strengthens responsibility for petty theft of someone else's property.
On Thursday, May 2, the Committee of the Verkhovna Rada of Ukraine on Law Enforcement considered the draft Law of Ukraine "On Amendments to the Code of Ukraine on Administrative Offenses Regarding Strengthening Liability for Petty Theft of Someone Else's Property" (reg. No. 11068).
Based on the results of the review, the Committee supported the changes proposed by the draft law and made a decision to recommend that the Verkhovna Rada of Ukraine adopt the specified draft law as a basis in the first reading. This was reported by the Verkhovna Rada portal.
Draft Law No. 11068, in particular, proposes to amend Article 51 of the Code of Ukraine on Administrative Offenses, namely:
- increase the fine for petty theft of someone else's property through theft, fraud, embezzlement or embezzlement up to UAH 850;
- provide for liability for the theft of someone else's property through theft, fraud, embezzlement or embezzlement, committed in a significant amount, in the form of a fine in the amount of fifty to three hundred tax-free minimum incomes of citizens (equal to UAH 850-5100);
- supplement the article with a note, according to which the theft of someone else's property is considered petty, if the value of such property at the time of the offense does not exceed 0.5 of the tax-free minimum income of citizens, i.e. 757 UAH.The draft law also provides for amendments to Articles 22, 38, 255, 268, 277 of the Code of Administrative Offenses, which relate to the procedure for bringing to justice for the above-mentioned administrative offense, in particular: the terms of imposing an administrative penalty (within six months from the date of its detection, but no later from two years from the date of its commission) and consideration of relevant cases, subjects of drafting protocols on such violations, possibilities of consideration of cases of offenses provided for by Article 51 of the Code of Administrative Offenses, without the mandatory presence of a person who is subject to administrative liability.

The draft law regulates the issue of legal relations in the administrative and criminal law spheres in order to ensure a more effective and fair application of punishment for the facts of petty theft, and also improves the qualification procedure for petty theft of someone else's property.
Adoption of the draft Law of Ukraine "On Amendments to the Code of Ukraine on Administrative Offenses Regarding Increasing Liability for Petty Theft of Someone Else's Property" (Reg. No. 11068) is an important step in improving the legal system of Ukraine.Increasing fines for petty theft, clearly defining a significant amount of theft, and setting specific time frames for prosecution will ensure a more effective and fair legal response to such offenses.
The proposed changes will help reduce the number of petty thefts, increase the level of safety of citizens and strengthen trust in law enforcement agencies. It is important that the draft law also provides for the automation of the processes of submission and verification of declarations, which will simplify and speed up the relevant procedures for both declarants and employees of the NAKC.
In general, the adoption of this draft law will contribute to the strengthening of the fight against corruption and petty crimes, which is an important step on the way to ensuring justice and law and order in Ukraine.
