Types of liability for violation of the rules of military accounting and the law on mobilization
There are administrative and criminal sanctions for violating the rules of military registration and the law on mobilization. Those who evade the draft can be punished with imprisonment for a term of 3 to 5 years according to Article 336 of the Criminal Code.
Laws have recently been passed that increase the fines for violating these rules. Law No. 3633-IX, which entered into force on May 18, and Law No. 3696-IX, signed by the President on May 17, strengthen responsibility for violations of the legislation on military registration and mobilization.
According to the Code of Administrative Offenses, the minimum fine for violating military accounting rules is 17,000 hryvnias, and the maximum is 25,500 hryvnias. For officials and legal entities, fines are even higher - from 34,000 to 59,500 hryvnias.
Law No. 10379 amends Article 258 of the Code of Criminal Procedure, allowing the issuing of "absentee" fines in the event of a person's failure to appear when summoned by the TPC without valid reasons. Criminal liability is also provided for evasion of military registration or special fees, with the possibility of a fine or correctional works.
Duty of citizens during mobilization
Citizens have a number of obligations during mobilization, including presenting military registration documents, appearing on summons to the TPC, providing property for the needs of the army, passing a medical examination, as well as performing defense work and mobilization tasks. Failure to fulfill these obligations may result in administrative or criminal liability.Men between the ages of 18 and 60 must carry a military registration document and present it upon request. In case of receiving a summons, the citizen must appear at the specified place and time.
Citizens who independently appear at the TPCand are subject to referral for training in connection with conscription for military service have two months from the date of passing the military medical commission to appear at the TPC. When receiving a summons, TPCrepresentatives must state their names and positions, as well as show their official IDs.
Good reasons for not coming to the TPC
Natural disasters, illness, hostilities, death of a close relative are important reasons for not arriving within the specified period. If a citizen cannot appear, he must inform the TPC about the reasons for his absence within three days after the date specified in the summons and appear within seven days.
Duty of citizens in reserve
Reserve citizens are assigned to military units or other formations for wartime duties. They are also required to clarify their personal data within 60 days after the law enters into force, including residential address and contact information, through the TPC, TsNAP or electronic cabinet.
Duty of men released from service
Men between the ages of 18 and 60, who have been discharged from service and have special ranks, must register for military service at the TPC within 60 days from the date of entry into force of the law.
