Cabinet of Ministers of Ukraine Approves Draft Law on the Improvement of the Procedure for Conducting a Special Inspection
The Cabinet of Ministers of Ukraine approved the draft Law "On Amendments to Certain Laws of Ukraine on Improving the Procedure for Conducting a Special Inspection." This was announced by the permanent representative of the CMU in the Verkhovna Rada of Ukraine, Taras Melnychuk. This draft law is aimed at optimizing the procedures and deadlines for carrying out a special inspection, which is provided for by the Law of Ukraine "On Prevention of Corruption", as well as at minimizing the paper document flow.
Purpose of the Draft Law
The main purpose of the draft law is to improve the conduct of a special inspection by:
Optimization of procedures and deadlines - acceleration and simplification of the verification process.
Use of information from state electronic information resources - application of modern technologies for information processing.
Minimization of paper document circulation - reducing dependence on paper documents, which contributes to faster and more efficient inspections.
Major Changes and Improvements
The Mechanism for Conducting a Special Inspection
The draft law proposes to improve the mechanism of conducting a special check, giving state bodies the opportunity to independently conduct a check on the basis of data obtained in the order of electronic information interaction between public electronic registers. This includes the use of a system of electronic interaction of electronic resources in electronic form or software interfaces of electronic information resources (services).
Exception for the Security Service of Ukraine
The draft law proposes to exclude a special check by the Security Service of Ukraine regarding whether a person has access to state secrets. Today, such information is checked only in cases when a person applies for a position, which implies the availability of access to state secrets, and does not affect the decision to appoint him to the position.
Amendments to the Law "On the Legal Regime of Martial Law"
Amendments to Part 8 of Article 10 of the Law "On the Legal Regime of Martial Law" provide for the organization of a special inspection provided for by the Law "On Prevention of Corruption" and an inspection provided for by the Law "On Purification of Power" regarding persons appointed during the period of martial law, regarding which such inspections were not carried out during this period. Such checks must be carried out within 30 days from the end of the deadline for submitting the documents required for a special check. You may be interested in the following articles: Legal analysis of the situation, Court proceedings, legal services, lawyer services, lawyer services, lawyers online, lawyer advice, lawyer services online, analysis, consultation, evaluation. legal analysis of the situation, lawyer's consultation, lawyer's consultation, analysis of documents, legal analysis of the situation, written consultation.
