Legislative definition of the term "cyber war": initiative of the Ministry of Defense of Ukraine
In today's world, where information technologies play a key role in all spheres of public life, cyber security is becoming a critically important component of national security. In response to constant and growing threats in cyberspace, the Ministry of Defense of Ukraine initiated work on the legislative definition of the concept of "cyber war". This initiative was discussed at the All-Ukrainian scientific and practical conference "Actual problems of state information security management", organized by the National Academy of the Security Service of Ukraine (SBU).
The need to define the concept of "cyber war"
The Deputy Minister of Defense of Ukraine, Kateryna Chernogorenko, emphasized that the Ministry of Defense initiated research work on the definition of the concept of cyber warfare, which is carried out by the SBU Academy. She noted that these developments will make it possible, together with other state bodies, to come up with legislative proposals already at the end of 2024.
The research work is aimed at creating a clear and comprehensive definition of "cyber war", which will include all aspects of this complex phenomenon, including the methods, means and objectives of cyber attacks, as well as the legal basis for responding to such threats.
Challenges for the judiciary
Since the start of the full-scale invasion, SBU specialists have neutralized almost 10,000 cyberattacks. These actions of the aggressor in cyberspace are systemic and aimed not only at Ukraine, but also at its allies.This creates new challenges for the judiciary, which must adequately respond to these threats and ensure justice in the conditions of cyber warfare.
The scientific-practical conference became a platform for discussing these challenges and finding solutions that will help the judicial system cope with new threats. One of these solutions may be the development of special legislative acts that regulate the procedures of investigation, trial and prosecution for cybercrimes.
International recognition of cyber attacks as an act of war
Recognizing cyber attacks as an act of war at the national legislative level is an important step. However, to effectively counter cyber threats, international recognition of such actions is also necessary. In today's globalized world, cyber threats know no borders, and coordination between states is a key element in successfully combating them.
At the international level, there are already discussions about the inclusion of cyber attacks in the category of military actions. The initiative of the Ministry of Defense of Ukraine regarding the legislative definition of the concept of "cyber war" is timely and necessary in the conditions of modern threats. The research work of the SBU Academy, aimed at creating a clear definition of this concept, will become the basis for the development of effective legal mechanisms for countering cyber threats.
Recognition of cyberattacks as an act of war both at the national and international level will allow the application of appropriate legal norms to the aggressors who carry out such actions.
