The Verkhovna Rada Adopted the Draft Law on Electronic Communication Fraud
On May 22, the Verkhovna Rada adopted in the first reading the draft law No. 10190 "On Amendments to the Criminal Code of Ukraine Regarding Establishing Liability for Electronic Communication Fraud." We wrote in more detail about this project here.
Key Provisions of the Draft Law
The draft law proposes to amend the Criminal Code with new articles 1901, 2554, and 2555, which provide for criminal liability for:
Electronic Communication Fraud (new Article 1901 of the Criminal Code). This includes illegal collection, storage, processing, and use of personal data, information containing banking secrets, including individual account information, payment instrument details, payment card details, authorization code, for the purpose of obtaining another person's property or acquiring the right to property by deception or abuse of trust using electronic communication and/or technical means of electronic communications.
Creating, Leading an Electronic Communication Fraud Organization, and Participating in It (new Article 2554 of the Criminal Code). This includes organizing groups engaged in fraudulent activities using electronic communications.
Involving Participation in an Electronic Communication Fraud Organization (new Article 2555 of the Criminal Code). This refers to actions aimed at recruiting new members into such organizations.
Purpose of the Draft Law
The draft law is aimed at strengthening the fight against fraudulent call centers that professionally deceive Ukrainian citizens. Fraud in the field of electronic communications has become a serious problem in the modern world, as criminals use advanced technologies to seize others' property.
The draft law aims to create an effective legal mechanism to combat these crimes. Strict punishment is proposed for individuals involved in such activities, which should become a serious deterrent for potential offenders.
The Problem of Electronic Communication Fraud
Electronic communication fraud encompasses a wide range of crimes, from phishing attacks to sophisticated schemes that use social engineering to obtain confidential information. Punishment Provisions
In particular, for creating, leading an electronic communication fraud organization, and participating in it, a punishment of 7 to 12 years of imprisonment with confiscation of property is proposed. Such severe punishment underscores the seriousness of these crimes and the need for their effective prevention.

The introduction of the new draft law aims not only to reduce the level of fraud but also to increase the level of trust of citizens in state institutions that protect their rights. Additionally, it will contribute to the formation of a safer information environment.
