Obtaining a fuel retail license
The licensing process is regulated by the legislation of Ukraine, in particular the Law of Ukraine "On Licensing of Types of Economic Activities", the Law of Ukraine "On State Regulation of the Production and Circulation of Ethyl, Cognac and Fruit Alcohol, Alcoholic Beverages, Tobacco Products, Liquids Used in Electronic Cigarettes, and Fuel » and other legal acts.
Licenses for the right to retail fuel in Ukraine are issued by executive authorities authorized by the Cabinet of Ministers of Ukraine at the place of trade of a business entity (including a foreign business entity operating through its registered permanent representative office) for a period of five years. The process of obtaining a license is regulated by the Law of Ukraine "On Licensing of Types of Economic Activity" and other normative legal acts.
The procedure for obtaining a license for fuel retail trade
The procedure for obtaining a fuel retail license includes the following steps:
Application preparation:
Prepare an application for obtaining a license, in which you specify information about the business entity, the place of trade, and the list of types of fuel that you plan to sell.
Submission of founding documents:
Submit copies of founding documents (statute, certificate of registration of a legal entity or an extract from the Unified State Register of Legal Entities and Individual Entrepreneurs).
Documents for the premises:
Submit a document confirming your right to own or use the premises or land plot where fuel trading is planned.
Technical documentation:
Submit technical documentation for fuel trading facilities, such as schemes, plans, inspection reports, etc.
Obtaining permits:
Get opinions and permits from state oversight bodies, such as environmental, sanitary, fire, etc., which confirm the objects' compliance with the requirements of the law.
Submission of documents to the licensing authority:
Submit all prepared documents to the licensing authority for consideration and obtaining a fuel retail license.
Document verification:
The State Tax Service checks the documents for their completeness and compliance with the requirements of the law. In case of a positive decision, the State Tax Service issues a license for retail trade with a valid term of five years. A state fee must be paid for issuing a license. The fee is set by the Cabinet of Ministers of Ukraine and may change.
Additional requirements for fuel trading facilities include compliance with technogenic and fire safety standards. This means that facilities must have proper fire protection systems, necessary fire extinguishing equipment and comply with the requirements for the storage of hazardous substances. Also, enterprises must ensure that their actions do not violate environmental regulations, in order to prevent environmental pollution.
Licensees should be prepared for regular inspections by government authorities to verify compliance with license conditions and legal requirements.
