Border escort : Departure of men who are persons with disabilities of the I, II, III groups or accompany a person with a disability
Due to the martial law in Ukraine, many men face restrictions on traveling outside the country. However, there are special rules for men who are persons with disabilities or accompany such persons. Let's take a look at these rules, required documents and border crossing conditions.
Border crossing rules for men
The legislation of Ukraine provides for a temporary restriction on the right to travel outside of Ukraine for conscripted men. However, the Law of Ukraine "On Mobilization Training and Mobilization" (Article 23) establishes an exception for persons with disabilities who have the right to travel abroad.
Departure of men who are persons with disabilities of groups I, II, III
According to the third paragraph of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization", persons recognized as disabled in accordance with the established procedure have the right to cross the state border. To confirm this right, one of the following documents must be submitted:
Reference to the act of examination by the medical and social expert commission (primary accounting documentation form No. 157-1/о) or
A certificate confirming the relevant status or
A pension certificate or a certificate confirming the appointment of social assistance in accordance with the Laws of Ukraine "On state social assistance to persons with disabilities from childhood and children with disabilities", "On state social assistance to persons who do not have the right to a pension and persons with disabilities". which indicate the group and cause of disability or
Certificate for receiving benefits by persons with disabilities who are not entitled to a pension or social assistance, in a form approved by the Ministry of Social Policy.
Departure of men accompanying a person with a disability of the I, II, III groups
The legislation also allows the departure of men to accompany persons with disabilities of the 1st and 2nd groups. The procedure is established by Clause 2-1 "Rules for crossing the state border by citizens of Ukraine", approved by Resolution No. 57 of the Cabinet of Ministers of Ukraine dated 27.01.1995. It is important to note that the legislation of Ukraine does not provide for the accompaniment of persons with disabilities of the IIIrd group.
Accompanying a disabled person is possible only once during the period of military or state of emergency. In addition, it is not possible for men to leave to care for sick parents, wives or children without their accompaniment.
