Owners of certificates for a land share or their heirs must do registration of land ownership.
A certificate for a land share certifies ownership of a land share and gives the right to receive a land plot in the future. Such a certificate contains data on the value and area in conditional cadastral hectares.
ТекстA certificate for a land share is not a confirmation of ownership of a land plot (therefore, it does not contain its exact size and boundaries). Such a plot of land will have clearly defined boundaries, size (defined in hectares) and location after the execution of the specified documents.
ТекстAccording to Art. 13 of the Law "On the procedure for allocating in kind (on-site) land plots to owners of land shares (shares)": in the event that by January 1, 2025, ( deadlines for registering land ownership ) the owner of an unclaimed land share or his heir has not registered the ownership right to the land plot, he is considered those who refused to receive a plot of land.

Land ownership registration involves:
• Applying to the village (village or city) council, on the territory of which the land share (share) is located, with a written application for the transfer of ownership of the land plot and granting permission to develop land management documentation regarding the establishment of land boundaries in kind (on site). A copy of the land share certificate must be attached to the application.
• Obtaining the appropriate decision of the local council.
• Appeal to the land management organization for the development of project documentation with land management and establishing the boundaries of the land plot.
• Obtaining technical documentation on land management.
• Applying to the bodies of the State Service of Ukraine for geodesy, cartography and cadastre or to the center for providing administrative services with an application to register land plots and assign them a cadastral number.
• Obtaining an extract from the State Land Cadastre with an assigned cadastral number.
• Appeal to the relevant local council for approval of the developed project documentation with land management.
• Registration of the land plot into ownership.
• Obtaining a decision of the local council to transfer ownership of a plot of land in the area.
• Application to the state registrar and registration of land rights (property rights to a land plot) based on the decision of the local council.
• Entering information about the land share (share) into the Unified State Register of Real Property Rights.
• Obtaining an extract on the registration of rights to a land plot.
ТекстWhat will be the consequences if this is not done and documents for the land plot are not obtained.
An unclaimed land share (share) will be transferred to the communal ownership of the territorial community on whose territory it is located by decision of the relevant local self-government body and on the basis of a court decision.
If you missed the deadline for valid reasons, you should file a lawsuit in court ( registration of land ownership through the court )
ТекстThe court can determine an additional period sufficient for carrying out such registration. However, the reasons for such omission must be reasonable and supported by proper and admissible evidence
