Who is a lawyer?
A lawyer is a legal specialist who provides professional legal assistance to individuals and legal entities. Lawyers play a key role in ensuring the realization of every person's right to legal protection and a fair trial.
The main functions and powers of a lawyer:
Providing legal assistance to clients. Lawyers advise their clients on legal issues, draft procedural documents, represent their interests in courts and other state bodies.
Protection of the rights and interests of clients. Lawyers defend suspects, accused and defendants in criminal proceedings, represent the interests of plaintiffs and defendants in civil, economic, and administrative proceedings.
Provision of legal assistance on a free basis. Lawyers can protect and represent the interests of persons entitled to free legal aid in accordance with the law.
Participation in the rule-making process. Lawyers can participate in the development of draft laws, provide expert opinions on draft legal acts.
Implementation of attorney self-government. Lawyers unite in lawyers' associations, which carry out organizational, personnel, material and technical support of lawyer's activities.In order to become a lawyer in Ukraine, it is necessary to have a higher legal education, pass a qualifying exam and obtain a certificate of the right to practice law. Lawyers are obliged to observe professional ethics, improve their qualifications, and contribute to the development of the Institute of Advocacy.
Guarantees of legal independence are an important element of the legal system of Ukraine. Lawyers cannot be held legally liable for statements made in connection with the practice of law, except in cases where the statements contain signs of a criminal offense. A search or inspection of a lawyer's workplace, as well as the requisition of documents related to the lawyer's activity, are carried out exclusively by a court decision.
