Requirements for rest time for employees of trade establishments
Introduction
The organization of rest time for employees of trade establishments is an important aspect of labor relations. Proper planning and observance of rest norms not only helps to increase labor productivity, but also ensures the preservation of the health of employees. In this article, we will consider the main requirements for rest time for employees of trade establishments, which are defined by the legislation of Ukraine.
Legislative framework
Code of Labor Laws of Ukraine (KZpP)
The Code of Labor Laws of Ukraine (KZpP) establishes the basic requirements for employees' rest time. Articles 66-84 of the Labor Code regulate various types of rest, including breaks during the working day, daily and weekly rest, as well as vacations.
Law of Ukraine "On Holidays"
The Law of Ukraine "On Vacations" supplements the provisions of the Labor Code, defining the procedure for granting annual vacations, additional vacations, and other aspects of employees' vacations.
Types of rest time
Breaks during the working day
According to Art. 66 of the Labor Code, employees must be given rest and meal breaks of at least 30 minutes and no more than two hours. Breaks are not included in working hours. At trade enterprises, where the work process cannot be interrupted, employees must be provided with the opportunity to eat during working hours.
Daily rest
Article 70 of the Labor Code establishes that the duration of daily rest between work shifts must not be less than twice the duration of working time on the previous working day (shift).This means that if an employee has worked 8 hours, his daily rest must be at least 16 hours.
Weekly rest
According to Art. 67 of the Labor Code, employees must be given weekly uninterrupted rest periods of at least 42 hours. This is usually two days off per week. In trade establishments, where work is carried out without days off, days off may be given on different days of the week.
Holidays
Annual vacations
The Law of Ukraine "On Vacations" provides that employees have the right to an annual basic vacation of at least 24 calendar days. For employees who work in harmful or difficult conditions, the duration of leave may be increased.
Additional holidays
Employees of trade establishments may be entitled to additional holidays, depending on the specifics of their work. These can be vacations for harmful working conditions, for the special nature of work, as well as social vacations (for example, for mothers with children).
