Provision of assistance in connection with temporary incapacity for work
1. Introduction
Provision of assistance in connection with temporary incapacity for work is an important component of the system of social protection of employees. This benefit provides financial support for the period when the employee is unable to perform his professional duties due to illness, injury or other medical reasons. In this article, we will consider the main aspects of providing assistance in connection with temporary disability in Ukraine.
2. Legislative regulation
2.1. Basic normative acts
The procedure for providing assistance in connection with temporary incapacity is regulated by the following normative acts:
Law of Ukraine "On mandatory state social insurance".
Resolution of the Cabinet of Ministers of Ukraine "On the procedure for accrual and payment of benefits in connection with temporary incapacity for work".
Other legal acts regulating social insurance and health care issues.
2.2. Substantive provisions
The legislation defines the rights and obligations of employees and employers regarding the provision and receipt of assistance, as well as establishes the procedure for calculating and paying this assistance.
3. Procedure for obtaining assistance
3.1. Issuance of a certificate of incapacity for work
In order to receive assistance, the employee must obtain a certificate of incapacity for work from a medical institution. The sheet can be issued in both paper and electronic form.
3.2. Submission of documents to the employer
The employee must submit the disability certificate to the employer together with the application for benefits. The employer checks the documents and submits them to the Social Insurance Fund.
3.3.Calculation of assistance
The Social Insurance Fund calculates benefits based on the submitted documents. The amount of the benefit depends on the employee's insurance experience and his average salary.
3.4. Payment of aid
The benefit is paid through the employer or directly to the employee's bank account. The Social Insurance Fund transfers funds to the employer's account, which, in turn, pays the employee benefits.
4. Amount of assistance
4.1. Dependence on insurance experience
The amount of benefits in connection with temporary disability depends on the duration of the employee's insurance experience:
Up to 3 years: 50% of the average salary.
From 3 to 5 years: 60% of the average salary.
From 5 to 8 years: 70% of the average salary.
More than 8 years: 100% of the average salary.
4.2. Calculation of the average salary
The average salary is calculated on the basis of the employee's income for the last 12 months, from which insurance contributions were paid.
4.3. Special conditions
For certain categories of workers, such as pregnant women, war veterans, Chernobyl residents and others, increased amounts of assistance may be provided.
5. Special cases
5.1. Occupational diseases and accidents
In the case of an occupational disease or an accident at work, the benefit may be higher than in the case of an ordinary illness, and may be paid under special conditions. You may be interested in reading articles on such topics as:
