Peculiarities of payment of sick leave in connection with pregnancy and childbirth
1. Introduction
The certificate of incapacity for work due to pregnancy and childbirth is an important document that guarantees financial support to women during pregnancy and childbirth. In this article, we will consider the features of payment of a sick leave in connection with pregnancy and childbirth, the procedure for its registration and calculation of benefits.
2. Legislative regulation
2.1. Basic normative acts
Payment of sick leave in connection with pregnancy and childbirth is regulated by the following normative acts:
Law of Ukraine "On mandatory state social insurance".
Labor Code of Ukraine.
Resolution of the Cabinet of Ministers of Ukraine "On approval of the Procedure for calculation and payment of benefits in connection with temporary disability, pregnancy and childbirth".
2.2. Substantive provisions
The legislation provides that women who work and pay insurance premiums are entitled to assistance in connection with pregnancy and childbirth. This benefit is paid for the entire period of maternity leave.
3. Drawing up a certificate of incapacity for work
3.1. Registration procedure
A certificate of incapacity for work due to pregnancy and childbirth is issued by a doctor at a women's consultation. The document is drawn up on the basis of a medical examination and confirmation of pregnancy.
3.2. Duration
Leave in connection with pregnancy and childbirth is granted for 126 calendar days (70 days before childbirth and 56 days after childbirth). In case of complicated childbirth or the birth of two or more children, the duration of leave is increased to 140 calendar days.
4.Assistance calculation procedure
4.1. Submission of documents to the employer
After receiving a certificate of incapacity for work, a woman must submit it to her employer along with an application for benefits. The employer checks the documents and submits them to the Social Insurance Fund.
4.2. Calculation of assistance
The Social Insurance Fund calculates benefits based on a woman's average salary for the last 12 months of work. The allowance is paid for the entire period of maternity leave.
4.3. Payment of aid
Assistance in connection with pregnancy and childbirth is paid once for the entire period of leave. The payment is made through the employer or directly to the employee's bank account.
5. Amount of assistance
5.1. Calculation of the average salary
The average salary for calculation of benefits is determined on the basis of the woman's income for the last 12 months, from which insurance premiums were paid. If a woman has worked for less than 12 months, the calculation is based on the actual period of work.
5.2. Calculation formula
The amount of assistance is determined by the formula:

where 30.44 is the average monthly number of calendar days.
