What is necessary for registration of land ownership
Yes, land in Ukraine is one of the most important natural resources. It is of great importance for rural and urban economy, industry, housing construction and other sectors of the economy. The land fund of Ukraine is divided into different categories according to their purpose, for example, agricultural, industrial, settlements, etc. Management of land resources in Ukraine is regulated by special legislation and state authorities.
Property is the right to own, use and dispose of property. Ukraine, as a sovereign state, has its own laws and regulations that regulate ownership of various types of property, including land, real estate, movable property, and others. Ownership can be private, collective (for example, jointly owned with other persons or organizations) or public. Each owner has rights and obligations determined by the legislation of the country.
State registration of land plots
State registration of land plots that were transferred to citizens for private ownership free of charge is carried out on the basis of technical documentation with land management regarding the establishment (restoration) of land plot boundaries in kind (on site). This technical documentation includes data on the location, size and boundaries of the land plot in real space. After receiving the relevant technical documentation, the owners of land plots can apply to the state registration authorities for the purpose of obtaining legal confirmation of their ownership of these plots.
The Land Code of Ukraine gives citizens the right to free private ownership of plots of land for personal farming, gardening, construction and maintenance of residential buildings, garage construction and other purposes. At the same time, taking into account clause 2 clause 1 of the transitional provisions, previously issued decisions on the transfer of land plots remain valid, which ensures legal stability and protection of citizens' rights.
State registration of land plots in Ukraine is a mandatory procedure that ensures legal protection of land rights and avoids ownership disputes. This procedure aims to officially record ownership of land plots and ensure their legal status. State registration of land plots is carried out in accordance with the requirements of the Land Code of Ukraine and other relevant legal acts.
The sequence of state registration of a land plot in Ukraine is determined by the Procedure for maintaining the State Land Cadastre, approved by Resolution No. 1051 of the Cabinet of Ministers of Ukraine dated October 17, 2012. This Procedure establishes a detailed procedure for maintaining the State Land Cadastre, including the registration of land plots.
This process includes the submission of the necessary documents to the relevant state body, their verification and the execution of the relevant registration record. The registration procedure includes several stages:
1. Preparation of necessary documents.
2. Submission of an application to the State Register of Real Property Rights.
3. Carrying out a cadastral survey.
4. Entering data into the State Land Cadastre.
5. Obtaining an extract from the State Land Cadastre.
6. State registration of land rights.
State registration of land plots is an important stage for legal protection of property and ensuring its legal purity.
