WORK OF THE DISABLED
A person with a disability is a person who has physical, mental or intellectual limitations that prevent him from full and effective participation in society on an equal basis with other people. Disability can be caused by various causes, such as birth defects, injuries, diseases or old age. A person with a disability can have varying degrees of limitations - from mild to severe.
The legislation of Ukraine defines the rights and social protection for persons with disabilities in order to ensure their equal participation in society. These rights include access to education, work, health services, social benefits and other forms of support. The main principles of protection of the rights of persons with disabilities include non-discrimination, equality of opportunities and social inclusion.
The work of persons with disabilities in Ukraine is regulated by special regulations that provide for special conditions in order to ensure their labor protection and integration into society. Here are the main aspects of the work of persons with disabilities in Ukraine:
Labor legislation:
According to the Labor Code of Ukraine and other normative legal acts, persons with disabilities are granted certain benefits and rights to facilitate their employment and work.
Social Protection:
Persons with disabilities have the right to social protection, which includes pension benefits, access to health care and other social benefits aimed at improving their lives.
Employment:
Employers are obliged to provide equal working conditions for persons with disabilities, and may also use benefits and state support to create special working conditions or workplaces adapted to their needs.
Vocational rehabilitation:
Persons with disabilities have the right to professional rehabilitation, which includes training, retraining and other measures aimed at improving their qualifications and opportunities in the labor market.
Adaptation of workplaces:
For persons with disabilities, special measures can be taken to adapt the workplace, for example, changes in the organization of space, use of special equipment or other technical means.
These measures are aimed at ensuring equal opportunities and social integration of persons with disabilities in Ukrainian society.
Article 172 of the Labor Code of Ukraine regulates the employment of persons with disabilities.
The main provisions of the article include:
1. Obligation to organize training, retraining and employment: the employer is obliged to organize training, retraining and employment of persons with disabilities in accordance with the medical recommendations of these persons.
2. Part-time work day or week: At the request of persons with disabilities, the employer must establish a part-time work day or week.
3. Preferential working conditions: The employer must create preferential working conditions for persons with disabilities, which includes the availability of necessary equipment, adaptation of the workplace and other measures aimed at facilitating working conditions.
4. Restrictions on the use of overtime and nighttime work: The law prohibits the involvement of persons with disabilities in overtime and nighttime work without their consent.
These provisions are aimed at protecting the rights of persons with disabilities and ensuring equal opportunities in the field of labor relations.
Compensation for damage caused to employees by mutilation or other health damage related to the performance of work duties is regulated by established legislation.
Here are the main aspects of damages in these cases:
1. Medical expenses: the employer is obliged to compensate all medical expenses incurred by the employee as a result of health damage during the performance of work duties.
2. Other types of compensation: compensation may also cover other types of damages, for example, the loss of the employee's income due to temporary incapacity or disability resulting from an injury.
3. Mobbing: In cases where an employee's injury is caused by mobbing (harassment) that has been recognized by a court decision, compensation is limited to medical expenses incurred. This means that the employer must compensate all costs related to medical procedures that were necessary to restore the health of the employee after such an injury.
The above-mentioned compensation and compensation payments are carried out in accordance with the procedures established by the legislation of Ukraine, which regulates labor relations and health protection of employees.
