The right of citizens of Ukraine to apply and complain
The right of citizens to address and complain is one of the main components of a democratic society. - Signature of the applicant (or applicants) and date.
Anonymous appeals, that is, those in which the surname, first name, patronymic or address are not indicated, are not subject to consideration.
Appeals that are not subject to review and resolution
Appeals shall not be considered if:
- They do not meet the registration requirements.
- They have already been considered and a decision has been made based on them, which the applicant was informed about, and do not contain new data or circumstances.
- The deadline for re-applying has not yet arrived.
The procedure for consideration of citizens' applications
Citizens' applications are considered in accordance with the procedure established by law.Authorities, enterprises, institutions and organizations are obliged to study the essence of the application, make a decision and inform the applicant about the results. At the same time, it is important to adhere to the established deadlines and ensure an objective and comprehensive consideration of the issue.
The procedure for consideration of citizens' complaints
Complaints are considered in a similar manner. If a citizen is not satisfied with the decision or actions of officials, he has the right to file a complaint with higher authorities or the court. Consideration of complaints is carried out taking into account the requirements of the law regarding objectivity and impartiality.
Deadline for submitting a complaint
Filing a complaint against a decision you are not satisfied with has clear deadlines. By law, you can appeal to a higher-level authority or official within one year of the decision. It is important to remember that the complaint must be filed no later than one month from the moment you read this decision. If you file a complaint after this deadline, it will not be considered.
However, if you missed the deadline for a valid reason, it is possible to renew it. The body or official dealing with your complaint may decide to extend the deadline if you provide good reasons for doing so.
If you are not satisfied with the decision of the higher body that considered your complaint, you have the right to appeal it in a court of law within the time limits specified by the legislation of Ukraine. This provides additional protection of your rights and the opportunity to achieve justice even in the most difficult situations.
Citizen's rights when considering an application or complaint
During consideration of an application or complaint, a citizen has the right:
- Get familiar with the review materials.
- Participate in the verification of the submitted application or complaint.
- Provide additional materials.
- Receive a written response regarding the results of the review.
The deadline for consideration of citizens' appeals
Appeals from citizens are considered within one month from the date of their receipt. If the solution to the issue does not require additional study, then the answer must be given no later than fifteen days later. In exceptional cases, when it is necessary to carry out a detailed check, the review period can be extended up to forty-five days, which must be notified to the applicant.
