Cybercrime: Legal Aspects and Methods of Combating
Introduction
Cybercrime is one of the most pressing problems of modern society, which is constantly growing due to the development of information technology. In Ukraine, as well as around the world, this problem is becoming more and more urgent, requiring effective legal mechanisms and methods of combating it. In this article, we will consider the legal aspects of cybercrime and the main methods of combating it in Ukraine.
Definition and Classification of Cybercrime
Cybercrime encompasses a wide range of illegal activities that are carried out using computer systems and networks. The main types of cybercrime include:
- Hacker attacks: Unauthorized access to computer systems to steal data, damage information, or misuse resources.
- Financial fraud: The use of computer technology to commit financial fraud, such as phishing, credit card or bank account theft.
- Distribution of malicious software: Includes viruses, Trojans, and other forms of malware that cause damage to computer systems.
- Cyberterrorism: The use of cyberspace to carry out terrorist acts or threats.
Legal Aspects of Combating Cybercrime
Legislative Framework
In Ukraine, the legal regulation of cybercrime is carried out on the basis of a number of regulatory acts, including:
- The Criminal Code of Ukraine: Contains articles providing for liability for cybercrime, in particular Articles 361-363-1.
- The Law of Ukraine "On Protection of Information in Information and Telecommunication Systems": Establishes the basic principles of information protection in IT systems.
- The Law of Ukraine "On Basic Principles of Ensuring Cybersecurity of Ukraine": Regulates activities in the field of cybersecurity and protection of critical information infrastructure.
International Cooperation
Ukraine is a party to a number of international agreements and organizations aimed at combating cybercrime:
- Council of Europe Convention on Cybercrime (Budapest Convention): The main international treaty governing cybercrime.
- Cooperation with Interpol and Europol: Ensures information exchange and coordination with other countries in the fight against cybercrime.
