What is the criminal liability for contracting a sexually transmitted disease?
Infection with a sexually transmitted disease is a criminal offense in Ukraine. The Criminal Code of Ukraine provides for liability for knowingly placing another person at risk of contracting the human immunodeficiency virus or other incurable infectious disease in Article 130.
According to this article, deliberately placing another person at risk of contracting the human immunodeficiency virus or another incurable infectious disease dangerous to human life, by a person who knew that he was a carrier of this virus, is punishable by imprisonment for a term of two to five years.
If such an act resulted in infection of the victim, the punishment is increased to imprisonment for a term of three to eight years. If the infection occurred in relation to a minor or several persons or had serious consequences, it is punishable by imprisonment for a term of five to ten years.
A criminal defense lawyer or criminal defense lawyer is often retained to protect the rights of individuals accused of such a crime. A criminal lawyer must carefully study all the circumstances and collect the necessary evidence to defend the client. His role is to ensure that the rights and freedoms of the client are properly respected, as well as to seek opportunities for mitigation of punishment or even acquittal.
The cost of a lawyer in a criminal case of infection with a sexually transmitted disease can be quite high, since these cases are sensitive and require a careful approach to protecting the client. However, despite the cost, professional legal assistance is essential to ensure a fair trial.
Although contracting a sexually transmitted disease is not a serious crime like murder, rape or robbery, it is still considered a serious criminal offense that can result in a lengthy prison sentence.
If a person has been illegally detained or taken into custody in connection with a case of contracting a sexually transmitted disease, a criminal lawyer can help with the removal of the arrest and restoration of the violated rights of the client. Criminal law provides clear procedures and guarantees for the protection of the rights of citizens, and the lawyer must monitor their compliance.
Consequently, criminal penalties for contracting a sexually transmitted disease are severe and can include imprisonment for up to ten years, especially if the infection occurred in minors or resulted in grave consequences. Therefore, the involvement of a qualified criminal lawyer is necessary to ensure effective protection of the rights and interests of a person in such delicate and complex cases. A lawyer must approach the case carefully and do everything possible to ensure a fair trial and respect for the rights of his client.
