Administrative liability for violation of pedestrian crossing rules

 

Introduction

 

Pedestrian safety is one of the most important components of road traffic. Pedestrian crossings are places where motorists need to be especially careful and follow the rules of the road (SDA). Violation of the rules of pedestrian crossings can lead to serious consequences, including injuries and death of pedestrians. In Ukraine, administrative liability for such violations is regulated by law.

 

Legal framework

 

Code of Ukraine on Administrative Offenses (CUAO)

 

The Code of Administrative Offenses establishes administrative liability for violation of pedestrian crossing rules, in particular:

  • Article 122: Violation of the rules of crossing intersections, pedestrian crossings or failure to give priority to pedestrians on a pedestrian crossing.

 

Traffic rules of Ukraine (SDA)

Traffic rules contain separate provisions for pedestrian crossings:

  • Drivers are required to slow down before approaching a pedestrian crossing.
  • Drivers must give way to pedestrians who are on the crosswalk or have stepped on it.
  • It is forbidden to overtake vehicles in front of a pedestrian crossing.

 

Types of violations and liability

 

Failure to give priority to pedestrians

 

One of the most common violations is failure to give way to pedestrians at crosswalks. According to Article 122 of the Code of Administrative Offenses, such a violation is punishable by a fine;

is subject to a fine of UAH 255.

 

Running a red light

 

Running a red traffic light on a pedestrian crossing is also subject to a fine. According to the same article of the Code of Administrative Offenses, the fine for this violation is UAH 510.

 

Overtaking on a pedestrian crossing

 

Overtaking vehicles in front of a pedestrian crossing is a gross violation of traffic rules. The fine for such a violation is UAH 510.

The following evidence may be used to establish the fact of violation of pedestrian crossing rules:

  • Testimony of witnesses: Testimony of eyewitnesses of events.
