Protection of citizens' rights when receiving legal aid

Introduction

Ensuring access to legal aid is one of the basic principles of the rule of law. Every citizen has the right to receive qualified legal aid to protect their rights and interests. In Ukraine, there is a system of free legal aid that provides legal services to socially vulnerable groups of the population. In this article, we will look at the mechanisms for protecting the rights of citizens when receiving legal aid, the legal framework, procedures for applying for and receiving aid, and recommendations for citizens.

Legal framework

The procedure for providing legal aid in Ukraine is regulated by the following key legal acts:

  1. TheConstitution of Ukraine guarantees the right to legal aid to every citizen.

  2. TheLaw of Ukraine "On Free Legal Aid" - defines the legal and organisational framework for the provision of free legal aid in Ukraine.

  3. TheCode of Professional Ethics for Attorneys - establishes ethical standards and rules of conduct for attorneys providing legal aid.

  4. Resolutions of the Cabinet of Ministers of Ukraine - regulates specific aspects of legal aid provision.

Primary legal aid includes the following types of services:

  • Provision of legal information: Explanation of legal norms and provisions of legislation.

  • Consultations and clarifications on legal issues: Providing advice on legal issues, assistance in solving legal problems.

  • Preparation ofapplications, complaints and other legal documents: Assistance in drafting documents required for applying to state authorities, local governments, courts, etc.

2. Secondary legal aid
